@pejman Mortazavi, that is very wrong. the poster is correct, you can qualify for EB2 NIW with bachelor’s plus 5 years work experience. people only try to avoid going that route due to the burden of proof of continuous employment.

@Richie Rich my I-140 was approved with a bachelors and 5 year expierence. they RFE with some question on my case but at the enf they approved it on a EB2

I received NIW with bachelor degree only. Previously, I was on O1 visa I’m engineer working with startups. I provided varies evidences that my work created more jobs in the USA and helps economics. I got references from startup ceo I helped with their growth and also show other criteria (judging others on event, patent, high salary) I work with a lawyer and she helped me to define my case correctly. I did premium process. I got RFE within a week. After submitting my RFE, I got a positive response also within a week. BTW, I worked for myself abroad. I didn’t work for the same employee for more than 2 year, except myself. And I have 15 years experience

@Bob Zeiger @hello goodbye can I get your email address to ask more questions? I have 6 years work as an employee and 6 years experience recently as an entrepreneur. USCIS seems to want to only want to use my employee experience but the issue is the company I worked with over 10 years ago doesn't exist.
