attorney problems
hi everybody,
in 2019 I got and attorney to start a green card process, my attorney recommended me to apply for a Vawa because of my previous marriage (at that time my husband). it took 2 yeas to apply to Vawa because she said it wasn’t the right time and she wanted to have a good case , at the time I agree with her but never though I was going to take that long , after pushing and getting frustrated, she finally file in 2022, I paid my attorney to represent me with that case and my removal order. I started paying her but after no having any income, I asked her if I could pay when my work permit was aprove.
at the moment she only has apply for I-360 and I have been waiting for a year and 2 months, she never apply for a work permit and haven’t done anything in my removal case because she said she waiting for my I-360 approval. every time I want to speak to her a need to wait for weeks sometimes a few months, she always said she was working in other cases.
long story short , now she wants to drop my case and wants to refer me to non profit attorney , and said that she can’t refund me because she work on my case.
what should I do?

i assume she did not apply for i485/i765/i131 along with i360, so the only work permit you can get is through i360 approval which is C31
since its applied in 2022 so min processing time for vawa now is around 3 years, so u have to wait another 1.5-2 years, what u can do is apply for i485/i765/i131, that way they can process your EAD through pending i485, that will also take around 8-10 months based on current processing times

@Alisa E, the problem about most lawyers is money not your life . for the first instance a good lawyer dorsnt have to wait for you to be in removal proceeding before he /she file for Vawa and when filling for Vawa , he will also file a new i-485 alongside with your work permit and advance parole. Meanwhile in order to put you in a tight corner and get their money from you bit by bit most of them will just file for Vawa and this is gonna put you or anyone else in serious trouble definitely u will be out of status once your current EAD expire and thats exacrly what is haplening to you.. I just pray your Vawa is approved on time so that u can strike out your case in removal proceeding meanwhile you look for a good lawyer to file i-485 with work permit and advance parole. best of luck.

100% agree with @Aji oye …you shouldn’t wait weeks or months to speak with your lawyer because she/he its to busy working on another cases (total bs)…anyway hopefully everything will be good at the end,@Alise E best of luck to you!

most of this lawyers I’m sorry are the problems in most cases…you need a new lawyer so you can file your green card and work permit..

@abdul malik, u need to cancel the removal proceeding process with your approved Vawa before u can apply for parole.

report her to the state bar, US DOJ, and USCIS disciplinary counsel to document the mishandling and have a basis to stay removal or appeal the order.

put that lawyers name out here,. u should not have to wait weeks or months to speak to your lawyer.. so sorry just time and money wasted. if anything just call the chidolue law firm and make a consultation.. 407-995-6567 they have payment plans I think as well
