Not sure, but my brother has an asylum case pending and they only gave him a drivers license valid for the time of his work permit and they wouldn’t let him get a license without proof of his work permit.

you can look for AB 60 driver license for undocumented immigrants, click on DMV website and gather all requirements and go from there. I got my AB60 driver license recently valid for 5 years but it gonna be three to four months process.

If you have a pending asylum case and you have the 797 notice of action that they received your case, you can get a temporary driver’s license for a year. At least in Florida, you can

Yes, me and my family have had a regular Florida license with pending asylum.. You need to find out what are the requirements in your own state, you can go to the DMV for it. In the case of Florida and other states, I think Indiana as well, the initial license can be obtained with just your 797 notice that the case is being processed.
Once you get your EAD that is valid for two years, then you can renew the initial license and have it for two years as well.
And of course, in all states you’ll have to take a written test and a driving test the first time. After that, you only renew the document.

The AB60 is a license specific to California, so if you don’t qualify for the above mentioned, look into that one. The regular state license offers an added benefit when traveling to other states (it’s what they call “Real ID”).

Like I said… You would need to take your international license, your passport, and the paper your received from USCIS after filing your case, that paper is called 797 Notice of Action

mohsin jamil - if you have an I-797 receipt, then you may be able to apply depending on what that I-797 form is for. if it is a renewal of your work permit then you will be able to get a driver's license. if it is the receipt for the original EAD, then I doubt you will get a license for now. it is best to call your DMV and ask them. they will have better answers for you.
now, with an international driver's license, you will be considered first time driver in the country, and you will have to pass all the exams that your DMV require before they give you a driver's licence. but again, call your DMV and ask the questions you may have on that matter. 🙂

mohsin - then you won't get a driver's license until you get the EAD because the two are tied together. the DMV gives you a state ID/driver's license that is valid for as long as your paperwork is, in this case the EAD. you will have to wait to get that EAD before you can apply for driver's license.
you need to have at least an I-797 that says your EAD request was approved before the DMV gives you a driver's license. and that's because you're waiting for the initial EAD.
but again, CALL YOUR DMV and ask them because every state is different. in some states right now you can't have a driver's license unless you have at least that I-797 APPROVAL. So, it is your responsibility to check what type of I-797 you have too, and what it says. 🙂

Take everything with you and see what they take, because it varies a lot from state to state, and it also depends on each DMV office; they don’t have a consensus.
Unlike Lilo Pelekai said, in my case, back in 2017 I was able to get a temporary 1 year license while my case was pending, with just the 797 Notice and without the initial EAD even being approved. Again, that was back then, and that was Florida. Each place will be different and you might have to go to more than one DMV until you find someone that is helpful.

Vir B - that's why I told mohsin to check what their I-797 form says because everything revolves about that and the EAD for pending asylum. I've had my driver's license renewed with just that form but my case was different because these were renewals. for initial EAD it may be different. I didn't encounter that issue for my initial C8-EAD because I already had a driver's license under F1 at the time. and back then it was in Florida too.
but mohsin will still have to pass all exams, written and driving tests before getting a license in the US, regardless of the state, since this will be their first time getting a US state-issued driver's license.
and at the end of the day they need to check what they need to bring with them from their own DMV in their state. I've done my license in 3 states and they all asked different things. it is a simple and free Google search. I'm just saying.

mohsin - telling them you have a pending asylum won't do anything. they know what documents they need to see for pending asylum and if you don't have them then you won't get anywhere.

In California you can apply for AB 60 driving license.
