Asylum approved through USCIS didn't wait 1 year and applied for I485
Hi my asylum got approved 5 months ago and applied for 1485 greencard after 1 month. Its been 4 months since i applied for permanent residence. How long will it take please help

@saib saib People who filed last year February 2023 are still waiting for the approval. But in few cases, they approved the i-485 in less than a year . Good luck

@j l the new law doesn't say you have right to apply right away this I lie,he want to spend couple thousand and refused good for him.

huge mistake! they will deny it as you don’t meet the 1 year requirement! I understand that you thought while waiting I will reach that year.. but no, they will look at your filing data vs asylum granted date.. how did your lawyer even let you apply?

@Lumi I agree with you, I know 2 people personally who were denied just because they I-485 filing date was after 10 months of asylum granted date. They don’t even try to adjust the date but denied and refered my friends to file a new I-485 application.Both cases happened in Sept 2022.

There is no “new law”, do not misinform people. From USCIS website. In order to be eligible for a Green Card as an asylee, you must meet the following requirements: 1.You properly file Form I-485, Application to Register Permanent Residence or Adjust Status; 2.You are physically present in the United States when you file your Form I-485; 3. You have been physically present in the United States for at least 1 year after you were granted asylum; 4. You continue to meet the definition of a refugee (for example, a principal asylee), or to be the spouse or child of a refugee (for example, a derivative asylee); 5. As my lawyer said, starting Feb 2023 you don’t have to wait one year to apply for green card. and he has thousands of asylum cases on his hand, I don’t think he will misguide his clients.

i also got approved last march 2023, but my lawyer didn't let me apply for I485 before fulfilling 1 year of granted asylum. i waited a year and then I applied
