Asylum and Pending I-485 through Citizen Spouse
In 2019, 1 applied for asylum in the United States but did not receive any follow-up documents regarding my application. Later that same year, I met my partner and we got married in 2021. As a result of the marriage, I became eligible to apply for permanent residency through my spouse. My I-130 petition for sponsorship was approved eight months ago, and I subsequently applied for the l-485 adjustment of status. However, my case is currently pending as I received a Request for Evidence (RFE) for further sponsorship documentation. Recently, I checked the status of my asylum application and it indicated that the next step is an interview. I am seeking advice on what steps to take next with regards to my asylum application while my I-485 application is still pending.

I will postpone the interview for asylum because if you get denied it will make it so complicated for your I-485

it says next step is interview but they have not send you notice for the interview yet. it means you don’t have to do anything for now for your asylum case. just wait until you get your green card and then you can send a letter with your green card copy to withdraw your asylum case.

I have exact same process like you and my i130 and I485 is still pending while my asylum is same as yours, I am not withdrawing my asylum application until my I130 and I485 are approved. All my EAD’s are from asylum because they were faster for me. good luck

if you get interview scheduled I would talk to an attorney to determine next steps. Tecnically you can withdraw your asylum since your I130 has been approved but that means you will lose the EAD thru asylum. talk to an attorney

@BB s I do not know exactly what’s right thing to do. But I would recommend to go to the interview still if it comes first or try to postpone the interview of asylum. So in this case you may buy the time and get approved with your AOS by marriage.

@BB s. First, that next step is an interview can stay that way for years, mine was actually 4yrs lol. So don’t do anything about it, if you withdraw your asylum application it can be seen as fraud during your AOS interview if you have one. Next, when they approve your AOS then you can withdraw your asylum, for me i sent an email and they withdrew it in two weeks

very good ! when uscis send you a letter the first time and you didn’t reply they will send it the second and this if you don’t still reply they will cancel themselves your case!
