Asylum and Marriage based AOS (2025/2026)
I filed for Asylum in 2017, and basically nothing has happened ever since besides a couple EAD renewals. The last renewal I did was in 2024, which was approved but surprisingly, instead of the usual 2year interval, i got 5 years (expires in 2029). Fastforward to July 2025, USCIS scheduled my first Asylum interview for August 2025, which I couldn’t attend for a couple of reasons. July 2025, my lawyer’s assistant mailed out a request to USCIS to reschedule my interview date and we basically heard nothing from them until Feb 2026. Meawhile, I got married to my USC girlfriend of over 3 years in July 2025, and in September, we filed for AOS(I-485 and I-130) concurrently. a few days later, USCIS mailed us receipts notices acknowledging that they have received our applications and that they’re currently working on them. Feb 2026, I got a mail stating that my asylum application was closed not just because I missed my interview but also because my Asylum office did not receive any formal request to reschedule, hence, they forwarded the case to an immigration court, and my court date is scheduled for March 2026. not gonna lie, I’m kinda concerned atp. Any thoughts guys? should I be worried about ICE being there on my first court hearing? what happens to my current EAD with the case having been closed by USCIS? and if the judge decides to close the case due to my pending AOS application, will I still be able to work with my EAD while waiting for my AOS to be processed?

I would say talk to a lawyer and if you can hire one to go would be good,don’t get me wrong they expensive but try to choose a good one @Positive Mindset

You have to file motion for dismissal. Some lawyers won't file for it until your I-130 is approved. Some lawyers will file while both cases are pending. I got mine dismissed while my AOS was still pending.

I have a question, how did you file for a I-485? I'm assuming that if you file for asylum it's cause you got in the US illegally? like without a visa or a permit? I have the same case as you but I still have my asylum open in court. I filed with my husband USC on Nov. 2024 and barely they send a message they're working on our case 24 days ago. but I cross the border without a visa and now I need a waiver to be able to apply for a I-485, and like I said I also have asylum pending..

@id lop, I did not come in illegally. came on a visa and was inspected. when was your first Court hearing?

@G g, You said yours got dismissed while your AOS was pending? were you able to continue working pending when your AOS finally got approved and how long did that take from the time your Asylum got dismissed till when your AOS got approved?
