arrest without conviction
hi, I’m an asylee with I-485 pending. I fought with my partner, he was holding me against my will. then I ran away and closed myself in the room and my partner said if I don’t open the door, he would call the police. so I ended up being arrested for domestic violence (they said because it’s his apartment and he called). I wasn’t convicted and all the charges were dropped. however now I’m afraid how this will hurt my chances of getting a green card. I wanted to ask if anyone had any similar experience

sounds like you would have to explain it at the interview, but being arrested and no conviction isn’t grounds for inadmissabilty as far as I know.

without conviction you arent guilty but forms do have a question for any arrest without conviction.. but since you already are in pending state.. i think yull be fine.. but thats only my impress

I had arrest, you should provide papers I think depostions proving that cases was dismissed. As far I know domestic misdemeanor is a petty offence you will be fine since it not related to moral issues

amy i wanted for us to cool off and asked for a few minutes to be alone, but he was breaking in and said he would call the cops if I don’t open. when I opened it was too late lol

there is thing called “seal and destroy” it’s basically erasing you data that you were arested. and then if you want to delete you bio date (witch were taken while booking you fingerprints, photo, dna) it’s stored in doj (department of justice) and prosses caled “expungement “ best way to do is just call any Defence attorney they charge around $500-$700 to do all of it. but it’s also possible to do yourself but takes time to google all of it.

Nik K my attorney already filed for expungement, but from what I understood is that USCIS and FBI still have records even after it’s expunged

To my knowledge expungement works exactly the way so doj and fbi must delete your data. Basically they have no right to hold, prosses or share your personal information if you requested expungement (unless you were convicted). If they still keep a copy of it that would be illegal, and theoretically you can held them lible for misuse of you personal data. But it will be quite complicated as any lawsuits with the government.
