Approved!
The day has finally come! Our I-130 got approved but in the letter it states whether we are going to fill out an I-485 or I-824.Mu spouse is currently in the US undocumented.If we go there to wait for the rest of the case will we be penalized? I notice the I-485 says they can use that document if they entered legally which he did not would i just do the pardon then. i need help y'all 😂

Suppose you want to change your selection (adjusting status in the US by submitting I-485 OR consular processing) after having already approved I-130. In that case, you may need to file Form I-824, Application for Action on an Approved Application or Petition. So, for example, when you submit I-130, there is a question if you are in the US and planning on adjusting your status OR if you would want to come back to your home country and do consult processing if you change your mind, then you would need to submit I-824. So, if you decide to do it in the US, you can submit I-485, I-765, and I-131, but you cannot travel outside of the US without pending I-485 and approved I-131. If you decide to return home with your spouse, I am unsure how that would work since the embassy asks for proof of income from the petitioner (your LPR or US citizen spouse). Maybe other people who know better will shed some light. Good luck
