Applying for I-539 after denial
Hello y'all, I have been facing a complex case where I applied for an I-539 for Change of Status from E2 to F1 visa. This was dismissed on the basis of "no-show" since I did not attend my biometric appointment. I then applied for a motion to reopen I-290B in September 2022, within the time limit they gave me. That motion too was denied in mid April. I then asked for case assistance from the Ombudsman who were not really helpful as well as well as through my congressman. After much deliberation, I decided to apply for a new I-539 after talking with multiple USCIS call agents. By this time, I have overstayed my visa and am no longer in status. Knowing that, I still applied for a new I-539 explaining my unfortunate situation. My question is this: If someone who had their I-539 denied and their motion to reopen denied and is out of status applies for a new I-539, what happens and can USCIS still forgive my overstay? I just want to complete my degree on time and gain employment. Simply missing a biometric should not have such harsh consequences. #biometricappointment #F1visa #student
