after 2yrs my appeal was still denied. it’s better you refile as it might take another year for you to hear from them and it is wasted

when my lawyer apeal my case they mail me a letter they incase they need next biometric they will mail me it's being 5 months now no more update

@hope fully when you apeal your case does they send you any notice the recieve your notice of apeal ?? for me they did send it after 3 weeks of apeal

july my lawyer send documents then they send notice to leave they country within 3 days or apeal my case within 3 weeks my lawyer apeal my case

yes my child father from my country send documents that's we were not legally marry and still they denied us

why uscis never send you to do a waiver

state that's com on law marriage between us was real so I have to prove it wasnt real marriage we never legally marry

@kim which country you from? if they accused you of fraud why they didn't send you to do form 601? I'm surprised your lawyer didn't send in a waiver

which field office you did your interview? I'm from guyana too. I did my interview in texas. it's been over a month I send in my response and haven't heard back from them

once you was accused of fraud and misrepresentation they should have send you to do a waiver which is form 601

you committed fraud and misrepresentation on your application so refiling with a waiver was your best option

correct. I had to prove I was married but at my interview in guyana I told the officer I wasn't legally married but he didn't make a note of it

hi I file and refile my case and they denied now I am an appeal about 12 months and nothing, shame merge they don't trust my merge even now that I'm pregnant and waiting one baby soon this story start since 2017 soon I'm going to be on 5 years merge we live a life apart.im so stressful

the waiver would have help you out big time. it would show hardships for your kids and husband.

it's so sad whenever u can't do this g to make your family happy or be together I'm going g true it I cant go vacation with my family's or does anything it's being a sad thing I keep thinking and praying every day at first I used to cry night and day and worried and nervous because I never went true this in my life

when I check other case status it show they same for my work authorization

someone told me they does make errors mistake and that's sound not good so I'm kind of worried because of my appeal case pending still

guys I receive letter 2 days ago what does it mean they receive my appeal and transfer it to they chief council officer to federal plaza and incase to make inquiries I must summit mail

the appeal just now left USCIS to the Justice dept that handles appeal for an independent decision. Now the only way to know your status is to call the BIA office but once a decision is made, they will send it via mail to you and USCIS

i went through it. The decisions is mostly denied (98%) but just hope and pray you night be the 2%approval. I currently refiled. I just wish I heard my prev lawyer to refile while waiting. my appeal took 2yrs and still was denied. Goodluck

@hope fully uscis never asked you to file I-601? just denial and you appealed?

it was a NOID (2yrs), Denial, appeal within 33days (2yrs +) which I did. all 5yrs wasted to start afresh again

I was sent a NOID and instructions to file the I-601

my advise: use a lawyer and listen to your lawyer. plus refile while waiting too so you don’t waste any more time
