AP approved based on VAWA
hi everyone my i130 got denied last year and I was giving 30days to appeal or have a pending case. I decided to apply for Vawa cos It’s really an abusive marriage. now my AP is approved for the Vawa and I will like to travel home. my question is do I have to withdraw the denied i130 or it has been closed automatically, cos I do not want to have a problem at the point of entry due to the denied i130 please advice. thanks

Personally, I never advice people to leave the country if it’s not for an emergency while this is pending. I also had a denied i130 and then applied for vawa and got an AP for 2 years but I never used it to travel. I waited and was patient and now my VAWA has been approved and I am praying to God my i485 gets approved early next year too. I don’t know of anyone that has had a denied i130, got an approved AP based on VAWA and left the country but I am sure there is. my advice is to stay unless it’s an emergency

@H O Last year, I applied for VAWA but I didn’t know about prima facie issued or my I130 was denied because I never got any online update. I traveled to Vietnam for 3 weeks then came back safely with combo card from marriage and VAWA receipt. Then I found out I130 was denied way long before I hopped on the plane. I mean if you don’t have any serious criminal or immigration issues before, relax and travel. But be always discuss with your lawyer about this! Good luck 🍀

@H O Your advance parole is not connected to your I-130 it’s connected to I-485. if you have pending I-485 along with I-360 VAWA application or from your marriage, if you don’t have a criminal background or any other reason they may stop you at the entrance you are good to go. I travel even though my I-130 is denied but that’s something expected because your spouse is no longer exist to be sponsor for you. Before I travel I checked during days if I should travel or not with pending I-485 and I did. officer was extremely friendly and no question was asked. always ask your lawyer though.

@Rachel I have a question I got a dui which is converted into reckless and I have AP can I travel and come back now and my reckless is in probation period right now will it be safe travelling ?

@H O, how long did it take for your AP to get approved? I put in for renewals about a month ago.

@H O , me and you have the same situations and I also wonder if I should travel or not. VAWA takes 2-3 years so I want to travel and visit my family.

it’s safe to travel until you don’t have any criminal background.
I also have the same situation and stayed home for two months !
my lawyer suggested me not to travel but I was mentally drawn that time

pls travel! my i-130 got denied when I switched to I-360 I have used my AP 4times! pls enjoy your AP and stop listening to this people on the internet! so far you have no criminal records! your i130 will be denied because you have the i360. don’t let these people fool you!
