@Baltimore fillers Yes i was in removal proceedings and the immigration judge terminated my removal proceedings based on i130 approval then i called uscis and the immigration officer told me am gonna give you infopass appointment at the local office and give them the termination letter so they can request your file ….I went to the appointment i filled out a form to request my file from the dhs … I took 3 months and 2 weeks for my file to arrive to the local office and they sent me interview appointment next January 31

@Marissa Is You don’t need infopass to get the termination letter I got the infopass to give the uscis the termination letter so they can get my AOS file from the dhs to adjudicate it the immigration court gonna send you the termination letter by mail it took 2 weeks to receive the termination letter from the court and if you didn’t receive the termination letter yet then I think because of the holidays and u should receive so soon

hi california, do u mind telling me how long does it take from ur judge to terminate your case after ur I-130 approved ?

@domino domino after my i130 approved we sent motion of termination to the immigration judge and the dhs attorney but it got denied then a few months later they announced a new memo to grant motion of termination for something cases like mine ( married to USC ) so we tried again to send the i130 approval and the AOS full package to the immigration court and the dhs and i had master hearing was coming soon ( thru a phone call and just with my lawyer) so the judge gave my lawyer some instructions to terminate the removal proceedings so we did and two weeks later we got the termination letter

that’s awesome. so u apply I-485 through Imigration judge and not through USCIS right ?

I applied thru the both we sent AOS to uscis and also to the immigration court and the dhs the file in the uscis service center still pending till today but I don’t need that file anymore because the uscis local office already got my other file from the dhs and scheduled interview for me

best of luck ! I’m in similar boat. applied I-130 last year and hasn’t been approved yet almost 400 days. but like u said there’s changing. PD ( prosecutorial discretion) is back. going to apply for I-485 to USCIS and hopefully when I-130 is approved the judge will terminate the case

hope ur i130 get approved soon mine got approved without even interview just right after you get i130 approved send the i485 to uscis and also to the immigration judge and the dhs with motion of termination

also don’t bother yourself and keep asking lawyers because most of them all awful they are just gonna give u negative energy and stress you out so u hire them I asked many lawyers and they told me 99% ur i130 gonna get denied for several times ( my i130 got approved from the first time without even interview) they told transferring the file from the dhs to the local office gonna take over a year ( It took 3 months and 2 weeks to get my file transferred and scheduled interview) just pray to god and everything will be fine

really? my lawyer who told me about to file I-130 imediately after I got married. they also the one who told me about prosecutorial discretion. we are going to file I-485 without i-130 being approved ( it will approved soon because it’s been 13 months). once PD is approved my lawyer with request for motion of termination with the judge

most lawyers won’t tell you the truth. my wife and I did everything and we just waiting for approval (decision).

@california2020 I’m in removal proceedings to my i130 was approved with interview and my lawyer file the i485 with uscis in the Imigration court to .I do my fingerprints and foto for my i485 on October 26 .Do you think I’m gonna have a another one interview for my package i485 ? I have a master hearing coming on February 2022 .I hope the judge terminated my removal proceedings for me

Baltimore : most likely u will need to go for interview again for I-485. I-130 is for the petitioner while I-485 is for the beneficiary
