Final adjudication
Need some opinions about my EB3-Unskilled AOS case situation.
My PD is Sept 28, 2021 and I have been current since March 2026. I already completed my interview in July 2023. Recently my congressman inquiry received this response from USCIS:
“Your case is currently under review by an adjudications officer. Your constituent should receive a decision or notice of other action shortly.”
I’ve also been hearing from some people that NBC is transferring many cases to field offices or non-local field offices for final approval.
So now I’m curious:
* Does “under review by an adjudications officer” usually mean final review stage?
* Can a case still be transferred after this point?
* Has anyone with similar wording recently received approval?
* Did your case stay at NBC or move to a field office before approval?
Just trying to understand where my case may be in the process after the interview. Thanks everyone.

i just want to be honest with you i think you are dreaming as it is really hard for anyone to get approval if you do it will be probably in a year or so

In uscis, “shortly” means 6 months to 12 months. so forget about it

do not loose hope. you are very close to the final step. Your case is transferred to the non local office for final adjudication because interview is not required now
Gc 0321May 26, 2026
My husband case is approved after 10 days from the day he recieved that same email respond from FO. He just did the Inquiry request not the Congressman.
Your case is about to get the good new soon.
Good luck

How did the interview go?
Tribal ChiefMay 27, 2026
did anyone see the notice on reddit that just got uploaded ( bdv applicant denial notice)?
sam youngMay 27, 2026
@Mandem FC yeah I just saw that’s crazy. I think that person is a bdv client and sponsored by McDonald Kansas City
Tribal ChiefMay 27, 2026
@sam young i mean what was he supposed to do is my question? i am quite confused with the reasoning they stated like having advanced degrees and all becuase i guess most of us came on f1 and likely completed their studies right? so what do we or what was he supposed to do?
T DMay 27, 2026
@Mandem FC Saw it too, but the post is locked by admins now and the poster did not give out any information or explain anything regarding the notice. Wondering if anyone had a similar notice before this
Tribal ChiefMay 27, 2026
@T D i happened to save the picture and pulled out the reasons
USCIS I-485 Denial Reasons
1. Inconsistent and Unreliable Evidence
Pay records were inconsistent and lacked evidence of full-time employment
The I-485 Supplement J (Job Offer/Portability Confirmation, dated Sept. 8, 2025) claimed full-time work at McDonald's, but records did not support this
2. Discretionary Factors (Negative)
Bachelor's degree in finance is inconsistent with the stated career goal of working at McDonald's
Did not cease other employment to focus on the qualifying position after receiving the interview notice
Engaged BDV Services to find an employer solely for green card purposes — employer has no connection to applicant's education or background
Relocated from Pennsylvania to Kansas for McDonald's, despite a more relevant prior position (Production Technician at Sanofi in PA)
Participated in a mock interview with an attorney before the USCIS interview, raising concerns about authenticity and spontaneity of testimony
Received scholarships/diversity funds potentially intended for those pursuing other career fields
3. Overall Discretionary Denial
Positive factors (bachelor's degree, approved I-140, U.S. citizen child) did not outweigh the negative factors
T DMay 27, 2026
@Mandem FC first time seeing a denial notice this detailed, what is your thought on this
sam youngMay 27, 2026
@Mandem FC one think I don’t understand is how do they know about the mock interview? secondly having advance degree doesn’t disqualify you and eb3 is for future employment that’s why you don’t really have to work for your sponsor until you receive your green card.
T DMay 27, 2026
@sam young rules change by the day at this point but i really want to know if this is real or not, since OP did not say anything else
sam youngMay 27, 2026
@T D I think the denial letter doesn’t belong to OP. He got it from one of his friends because he mentioned in the comments. I think it’s real for sure
BDV PUBLIC ENEMY #1May 27, 2026
I wonder if this denial can be appealed.
Tribal ChiefMay 27, 2026
@BDV PUBLIC ENEMY #1 idk on how basis he will appeal this denial. They seem to have pointed out every negative factors resulting in denial
Tribal ChiefMay 27, 2026
@T D idk feels weird my question still remains the same. what was he supposed to do?
Tribal ChiefMay 27, 2026
@sam young kansas city fo seems to be working in a diff dimension it seems. things they pointed out resulting ro denial seems weird
BDV PUBLIC ENEMY #1May 27, 2026
@Mandem FC I mean at this point they can literally use anything against you and call it "a matter of discretion"
sam youngMay 27, 2026
@Mandem FC yeah you are right. what was he supposed to do? that’s a legal pathway and everything is done correctly by the book still they denied him like WTF. Reason for denial doesn’t make any sense at all
BDV PUBLIC ENEMY #1May 27, 2026
On the other hand the user AR on a prior post who literally has never worked for sponsor and was still on F1 got approved.
sam youngMay 27, 2026
@BDV PUBLIC ENEMY #1 exactly. I think in this process it all depends on luck.
Tribal ChiefMay 27, 2026
Yep, it is all down to the officer, it seems.
talha khalidMay 27, 2026
it was fake denial because he posted I 130 and I 485 on the top
Tribal ChiefMay 27, 2026
@talha khalid doubt it was fake,
talha khalidMay 27, 2026
it is not there anymore
