I don't think you should drop your asylum case, if for some reason the i485 got denied, the only case would be holding you in the country would be the asylum case. Not sure why the i485 case has being moved to asylum office. We have pending asylum at the Chicago Asylum office and EB3 AOS at the National Benefit Center. We were instructed to drop the asylum case once the I485 is approved. We have 2 lawyers working on our case, one for the EB3 paperwork and the another one just for the asylum case. You should get one for the asylum case to get legal advice. Best of luck!

A friend has a situation may help. he has an asylum case. Got married to US citizen his i-130 (marriage application form) got approved. He been informed that his I-485 (GC application) won’t be process until he clears the asylum case

@P C I have two lawyers as well. one represents my 485 and one handles my asylum. the asylum lawyer advised me to wait until 485 gets approved before withdrawing asylum. but how can the 485 gets approved if the asylum office withholds the 485. asylum office has no jurisdiction over 485. they can’t adjudicate 485.

@A G who informed your friend that his application won’t be princesses until he clears Asylum? asylum case can take years to get adjudicated while marriage or employment are faster to be adjudicated

I checked with him, his attorney, something forgot to mention, his asylum case been transferred to immigration court. Hence, seems he might be in different situation than yours.. that’s why he could need to clears from court first

@A G thanks for letting me know. i see. immigration courts are different. I have never been out of status.

@P C have you checked where your 485 case is currently at? my 485 was at NBC and then got transferred to the FO in Ft Myers. Then the FO in Ft Myers transferred the 485 file to the Houston asylum office.

My I485 case is at NBC since day one. Right now, our step is "CASE WAS UPDATED TO SHOW FINGERPRINTS WERE TAKEN"; I got the EAD card already. I131 not updated yet.

@P C My i485 status shows the same as your status. I called the USCIS and that’s how I discovered the 485 is at the asylum office

someone on telegram says — “They normally would want to check what put you out of status wheather that caused by asylum or something else before allow you to adjust..”

@Azi A did you have to do anything to get it transferred out of the asylum office? My EB AOS case was also transferred to an asylum office in May 2022 because I have a pending asylum case.

@D WL @God is good savior of the world (Jesus) I am still waiting for the approval. I received an RFE in February 2024 requesting for an updated medical examination and Supplement J. My lawyer had responded in March 2024. There is no update on my case since. Online case history did not indicate that the RFE response has been received. I submitted the inquiry with the Congressewoman and the USCIS had indicated they received the response. In May 2024, I submitted a second inquiry through the Congresswoman and the USCIS responded that my case is going through the background checks. My lawyer submitted a service request because my case is already outside of processing time (at least 37 months pending) while Houston average processing time is 29 months. USCIS indicated they had responded to that SR but we never received anything. I need help :-((
