Anyone using EAD in EB2NIW while 485 pending and 140 approved
hi there, can I use EAD card meanwhile my 485 says case remain pending from June 2023. my PD is of sep 2022 and don’t know when it should be current as the action date is July 2022.
is anyone here in EAD for job, or have used EAD before getting green card? do I need to worry for anything for using EAD? any useful suggestions?

My wife is a primary petitioner and I am her dependent. my wife is in F1 and I am on F1 stem OPT. As we both have EAD and I am planning to use while she will still maintain F1.

EAD is to use. why you question it? go get a job man. that’s why they gave it to you.

@AS SA I know EAD for job. thanks for letting me know on that. I don’t know if you have filed through EB2NIW or not? Lawyer usually don’t recommend using unless it’s pressing issue. I am Just looking some suggestions and to be on safe side before using EAD. Have you used EAD?

@jay bill can I know what’s your visa status on ? have you received EAD and used yet?

If you use EAD, your current F visa status will be gone. Then your lawful stay in the US is only based on "I-485 pending status". Your EAD is also based on I-485. In case of your 485 being denied, you may have to stop working and leave the US right away. Attorneys want riskless option which is not using EAD, but if you are confident of your 485 application flawless, then why not use EAD?

@S K K the only problem with EAD is that you cannot concert back ‘pending AOS’ status to any other status like F1 or H1b while in US. you will need to go out and get consular processing. this is only in case when AOS is denied. otherwise all good
