Anyone know how to sue the USCIS?
I have filled my I 129F since February 2021 with the California Processing center, in March of this year I filled for an inquiry because my application was way past the Normal processing time. on 19th of April USCIS responded to my inquiry saying that my case was in adjudication and I should get a decision within 45 day. it’s been 43 days and still haven’t heard anything back yet! I’m currently deployed and there’s so much I can do at this point. has anyone ever filled a lawsuit against USCIS? I want to know how to go about it? I’m tired of this long wait!

I highly recommend consulting a good immigration attorney before taking uscis to court. it may sound simple but suing government agencies gets complicated too fast. not to say it’s not possible, it very well is and a lot of people have been successful in doing so. Just make sure you do your homework and have a good attorney before taking this vital step. Good luck!

not 45 days but 45 business days excluding Saturdays and Sundays.

I will also add that litigation can be expensive, so keep that in mind.

I would recommend just being patient. Everything is taking longer now, so you will just waste a lot of money.
