any issue to go back home after asylum closed with no updates
Hi. Got my GC in 2022 through my spouse. Had an pending asylum which never had any update and got that closed after getting GC through marriage case. Is it ok to travel back home country without any issue? The issue I had of fear personal reason is changed in my country and rules have gotten better and LGBT marriage got legal in 2022 too. So I don’t have threat I possessed in 2015 when I initially filed asylum.

I won’t advise you go back until you have gotten your citizenship in the US. it might be an issue for you coming back into the US if you go.

if you go back it is considered cessation and your GC is forfeit.

in my opinion, since you got your green card already through marriage and your asylum case has been closed, I think it’s safe to travel home. You are already a permanent resident so it doesn’t matter whether gay marriage is now legal in your country or not. Just don’t stay up to six months away from the US. Research more on this but im damn sure im right.

@Justin Samuels since it’s through marriage and now the fear you had before is no longer there I think you can go back to your home country but I’d consult with attorney just to be safe

@jojo Amani did you get your asylum case closed before your travel? I’m in the same situation. traveling soon but asylum is still pending. sent my withdraw letter five months ago.

@J W I didn’t close anything because I don’t know how to do it….. someone said marriage to a US citizens overrides everything so I think that was what happened! be safe I wish you safe trip

@jojo Amani By closing I meant withdraw. I saw you commented under other posts mentioning you sent a case withdraw letter to the Asylum office a while ago. Have you ever heard back from them notifying the withdraw is successful? Thank you for your kind wishes!

@J W I traveled to my home country I didn’t go with my kids so Incase anything happens they can run around for me…. because I have a 22yrs old…. but I was only delayed for 10mins and they ask me to go at the port entry

@J W no they didn’t ask anything they collected my Advance parole card and took it in then brought it back after 10mins and ask me to go… not just me couple of other ppl
