the EAD maybe under category C31 which they won’t produce until after i-360 is approved. If you applied for i-485 you can apply for EAD under category C09 this one is approved much quicker, if you’ve already applied for i-485, apply for EAD under C09 and attach the i-797C for the i-485 so you don’t have to pay any fees (this is only doable if your spouse was a USC or a LPR and your visa number is current.

do you get Prima Facie? if no, you have not established your VAWA

please what if you get Prima Facie and your Ead under category C31 can USCIS approve the EADC31 before Vawa approval. I applied January 2025 Vawa, Ead c09, Ap, and linked my pending i 485 to my Vawa but USCIS Issued my receipt notice Under category c31. fingerprint were reissued on April , Got 1 year Prima Facie on May. August i131 fingerprint were take. so in this case can USCIS Approve my Ead and AP before my Vawa approval? please quick question

@GOD HAVE MERCY Here you go again spewing trash. Lots of people don’t get prima facie which is necessary not because they haven’t met or established proof but because sometimes the officer who could be new didn’t go ahead to issue them or it was caught up in some process. lots of people from 2022 up till early 2024 were not issued a prima facie. From analysis here some even got theirs just before their approval. Secondly having a prima facie determination is not a proof that your Vawa will be approved. There are lots of proof on that same as people with a prima facie got approval. If he doesn’t meet the requirement they would send an RFE requesting additional information to support a petitioners claim. So pls only say what you know.

@GRACE OF GOD No USCIS will not issue you a C31 EAD before your Vawa approval. You can only get that when your Vawa is approved. But if you filed for an EAD under the C09 category that would be issued to you between 7 to 9 months from date of application.

I think the Mistake is from USCIS because my lawyer filed under the category of c09 but They issued my Ead receipt under the category of C31. After that my lawyer make an inquiry to USCIS to correct or issue the correct category receiptC09 but since 4months now there’s no response from USCIS. so my question is can they correct it internally and issue my Ead under category C09 without response to lawyer inquiry? or what do you think

@blessed & favored I just know i360 and i765 were filed. my attorney filed my paper work so im not sure exactly what other forms were filed. i know i360 was under category c31. my spouse is a USC. what do you mean by visa number is current? should i ask for copies of what was filed for a better under standing?
