According to the most reliable attorneys, the short answer is, no. The reason for this is the difference in focus. My case has a better chance for a National Interest Waiver (NIW) because, for an EB-1 visa, I would need to provide an stronger profile to demonstrate my achievements, such as having more than 1,000 citations, in addition to other evidence proving that I’m on the top of my field, and that is almost impossible for me to obtain in STEM, to show substantial merit. So I had to go for NIW, and now after almost 13th months I’m still without an answer.

The only (small) upside is that you aren’t current in the bulletin for either filing or final action. So in terms of net time you hopefully aren’t losing out. But I can definitely understand the anxiety with not knowing.

@Kar NIW i140-Nov 2023’ it's nice to know a bit more of you. See that you're very qualified, but still, facing the delays. I thought that people with citations, publications, etc had some sort of priority. Good luck over there.

@eb2 guy Oh no, no priorities at all… more seems like a mystery how they adjudicate! It feels like cases are being worked on completely at random, rather than in any specific order. I've seen so many files just sitting there for months, with some people waiting over 450 days—unbelievable., Others are even getting Requests for Evidence (RFE) by this point. It’s truly puzzling how the review process works. But I’m holding onto hope that, when our time finally arrives, we'll all receive positive outcomes and be able to move forward! and as soon as possible!

@adam smith I have a feeling that it will happen in 2025. Actual PD is now April 23. With Trump in power, I think he will compensate the "great deportation" getting people legally to enter the country.

@ade O Let me try to explain why; EB-1A (Extraordinary Ability): This category is retrospective, focusing on the applicant's past achievements and recognition as one of the top experts in their field. Applicants must demonstrate "extraordinary ability" in areas such as science, arts, education, business, or athletics, evidenced by sustained national or international acclaim. Meeting at least three of ten regulatory criteria, such as awards, membership in prestigious associations, or original contributions, is required. The standard is high, emphasizing that the applicant has risen to the very TOP! of their field, which is not my case. EB-2 NIW (National Interest Waiver): This category is prospective, focusing on the applicant's proposed contributions to the United States and their alignment with national interests. Applicants must either hold an advanced degree or demonstrate exceptional ability and satisfy the three-pronged test from Matter of Dhanasar: their work must have substantial merit and national importance, they must be well-positioned to advance the work, and waiving the job offer requirement must benefit the U.S. Compared to EB-1A, the threshold for qualifications is lower, emphasizing future potential over past acclaim. As you can see, while (In my opinion) I have strong achievements and supporting evidence, my qualifications better align with the EB-2 NIW criteria, which focus on the future impact of my work and its national importance. The EB-1A requires a higher standard (>1K citation over 10 years, Patents >2, etc., for STEM "it's an open secret." WINK WINK…) of extraordinary ability, emphasizing top-tier recognition that I may not fully meet. This makes EB-2 NIW the more suitable and realistic pathway for my case.

@Kar NIW i140-Nov 2023’ Well, thank for detailed explanation on both EB1 &EB2...presently my EB2 timeline: PD JULY 2023...APPROVAL FEB 2024...Again, based on the testimonials I read on a EB1A group Whatsapp group, your profile is good. There person with far lower profile than yours with EB1 approvals.
