any EAD approval from TSC
hi all, did anyone get approval for EAD recently? I have been waiting without job for 6 months and still there is no sign of EAD.

no ead ?
V SJan 24, 2022
no.
A SJan 24, 2022
sorry I mean if this is emp based was there no extension on the visa so that you could have continued work ?
V SJan 24, 2022
right. no extension available on my L-1 visa. multiple expedite requests denied by USCiS office
ann green cardJan 24, 2022
april and nothing
Ben GaloreJan 24, 2022
what did you file to support your expedite request ? job offer ?
V SJan 24, 2022
personal financial losses.
Ben GaloreJan 24, 2022
and no family to support ? that's weird they don't accept the expedite request. I've some fair argument about why it's refused for the spouse of an L1 but for the main visa holder.
V SJan 24, 2022
yes. it’s weird. the processing times is a moving target. waiting and doing nothing is the cause for most disgruntlement.
Ben GaloreJan 24, 2022
did you document the fact that you are the only source of revenue of your family? proof of employment loss, bank account, lease, utilities bills ... normally well documented and with a job offer that should work. I will suggest to do that via your congressman as they can gather all the documentation and pass it along
V SJan 24, 2022
I have given all those things you mentioned. thanks for that. went through congressman as well for the second time. still they denied. currently a thread is opened through the Senator office. they(USCiS ) have 30-60 days sla to respond. I have to wait for at least another month to get any response from them.
A SJan 24, 2022
this is crazy .. I hope it comes through soon ..
V SJan 24, 2022
thanks @AS and @Ben! do share your stories!
Ben GaloreJan 24, 2022
on my side I submitted the AOS in TSC in June, bio in October but my current visa is valid. I'm still surprised to see that they can let a family without any source of income. How do they expect people to leave ?!? moreover it takes a few minutes to generate an EAD, less than having to manage several expedite request
A SJan 24, 2022
my app was submitted Oct 2020. we got ead and ap but gc is pending. my spouse and I completed our interview as well in Chicago but really seems different as I see most getting waived but yes we had to appear, since then heard nothing. eb1 c
Graceful ManJan 24, 2022
I have the same case but I only filed I-140 which was approved after 2 and half years from Texas
V SJan 24, 2022
thanks for sharing! @AS @Ben good luck!!
V SJan 24, 2022
@rehan have you filed 485 yet?
Graceful ManJan 24, 2022
yes I have filed last month and done with my fingerprints too
V SJan 24, 2022
@Ben I totally agree with you on the EAD generation! but I think there is some deliberate delays induced in the system following Trump rules still.
stu riddleJan 24, 2022
I'm in the same situation, filed may 28th. completed biometrics back in August and nothing since. 8 months of unpaid leave, expedite requests all denied despite me being the only source of income with 3 dependents, including 2 us born children. USCIS do not care at all, its all politicized in my opinion and luck in terms of who your case worker is. fingers crossed the nightmare ends soon
Graceful ManJan 24, 2022
Texas is taking long time
V SJan 24, 2022
@stu is your case filed in Texas?
V SJan 24, 2022
@ann have you expedited your case if so did you use any Senator or congressman office to expedite?
Ben GaloreJan 24, 2022
@stu did you think about filling a lawsuit? that looks like it's applicable in your case
stu riddleJan 25, 2022
filed in Nebraska. I'm looking into a lawsuit atm, trying to join this class action...https://www.aila.org/advo-media/press-releases/2021/class-action-challenging-huge-uscis-processing
Ben GaloreJan 25, 2022
@stu let me know if that worked (joining) I think they were not accepting new plaintiffs but since 50% of them got their EAD they may reopen.
V SJan 25, 2022
@stu thanks for sharing this. i would like to join this. pls let me know how to.
Ben GaloreJan 25, 2022
I know some of this companies are also able to file a lawsuit individually for the same outcome. maybe more expensive
Ben GaloreJan 25, 2022
and keep in mind that premium processing for i765 may arrive soon ... and maybe cheaper (max 1500)
stu riddleJan 25, 2022
the class action is currently closed for additional beneficiaries but there was a link to express interest as the website suggested it may reopen soon. I'll find and post the link shortly. worth noting that if the federal judge agrees it as a class action, there is no need to join the lawsuit as all petitioners in the category will benefit from USCIS mandated action. The benefit of joining is if the federal judge decides its not a class action. then only petitioners benefit
Ben GaloreJan 25, 2022
good to know. And how is the class defined ? petition pending for more than 180 days ?
V SJan 25, 2022
ok. pls share the link however
stu riddleJan 26, 2022
here is the link to the class action https://www.immpactlitigation.com/ead-delay-lawsuit-plaintiff-onboarding/
stu riddleJan 26, 2022
@ben I'm not sure exactly but the original plaintiffs in the case all filed in may 2021
V SJan 26, 2022
thanks. let me check. have you joined?
V SJan 26, 2022
i put my name in the waitlist. thanks @stu
Ben GaloreJan 26, 2022
I'm not sure you can still join
V SJan 26, 2022
only waitlist. if they are adding more then they will email to join.
Ben GaloreJan 26, 2022
how did you join the wait-list ?
V SJan 26, 2022
in the link above there is another link in the FAQ to join the waitlist. https://gsiskind.app.law/waiting-list
Ben GaloreJan 26, 2022
