yup, that’s completely legal an you should not have any issues. filing married separately is something I did for my application and so I believe is completely fine otherwise it wouldn’t be an option to be honest. if they question why you guys filed married separately, you can just say is because you got better results as far as taxes is concerned which is valid.

yes you do need to file them together for the 751. you can file married and separately but you need a good reason for it. they will prefer married filing joint.
