Annual Limit Reached in the EB-2 Category

The State Department, working in close collaboration with U.S. Citizenship and Immigration Services, is pleased to announce the issuance of all available visas in the Employment-Based Second Preference (EB-2) category for fiscal year (FY) 2024. Maximizing these visas facilitates legitimate travel for individuals with exceptional ability and professionals holding advanced degrees. These individuals bring contributions across many industries that greatly benefit the U.S. economy.
The Immigration and Nationality Act (INA) limits the number of employment-based preference immigrant visas that may be issued within a fiscal year. Specifically, INA 203(b)(2) provides that the annual limit for EB-2 visas is 28.6 percent of the worldwide employment limit.
Since all available EB-2 visas for FY 2024 have been used, embassies and consulates may not issue visas in this category for the remainder of the fiscal year. The annual limit will reset with the start of the new fiscal year (FY 2025) on October 1, 2024. At that point, embassies and consulates may resume issuing immigrant visas in this category to qualified applicants.

@Charlie SC To be expected I guess considering they already ran out of EB1, EB3, EB4 & EB5. At least we are not too far away from FY2025 starting.

I don’t really understand this. does it mean that they won’t approve any EB2 petition again till next fiscal year ? or the green card for those with EB3 will be stop till October. please someone should explain to me.

@Ramon Adegoke They will continue to process I-140 petitions for all EB categories. But there will be no further completions of any I-485 adjustment of status for EB categories until the new fiscal year starts on 1st October 2024 and the numerical limits reset.

Look at USCIS statistic data. They have huge backlog. They shouldn’t move any date further in new FY.

thanks God @Charlie SC @CHEN-KAI HSU @Mr BD you are not USCIS officers. why should not move any date ?? I agree to move forward like 2024 FY slowly each quarter to solve this at lease people close to be out of status get benefits of filing like you got guys

@Charlie SC In August I received a RFE for medical, USCIS already received it. I think my case loss the momentum. Everything thanks to my Super Lawyer, she always rather wait for the RFE instead to send it in avance

this notification might serve the consulates and embassies, I guess. they will continue to approve I-485. they know how to manage things

@AW mommy Yeah. I’m not. but I think they shouldn’t move any date further before backlog is under certain number. I guess you are waiting date to file. Aftet you file and if you are unlucky one who can’t get luckily picked up by ISO, trust me, you will feel the same way.

@CHEN-KAI HSU my pd is March 22, 2023 I see approval for people with Feb 2023. is it fair to wait more than 1 1/2 year to fill, where other people got approval 2 month difference between us

@AW mommy Then he his lucky. If you looked at USCIS statistics data, there are over 30K EB2 that are pending over 6 months and with even early priority date (2022 or 2021 or even early). We all know that USCIS likes to do FIFO. What should those people do?

@AW mommy not sure why it’s relevant. I am from ROW. I know lots of EB2 folks with PD Aug 2022 are still waiting for decision and pending for over 8 months, including me. If USCIS keeps doing FIFO, we are never got the chance to be approved.

might be your country should be in separate column, these nationality made this blockage, but a lot of approval last weeks up to Feb 2023

@AW mommy I am from Taiwan. I don’t think Taiwan creates backlog like South Korea or Brazil.

@Jim HSU is there usually a higher backlog for South Korea or Brazil? so if you’re born in one of those countries, expect further delay? my PD is Aug 2022, RD Dec 2023, still waiting for my I-485 approval and zero update since fingerprint applied in Jan 2024…quite frustrating…

@C P I don’t know. you should check with @AW mommy . He/she has maybe better view. I don’t think Taiwan can easily exceed 7% country cap. In fact, I just noticed that a Taiwanese people just got EB2 visa through consular processing with Pd of late Feb2023 last week. I think the processing time is actually and purely based on your luck.
