This can be evidence that was never previously available or evidence that you had but never sent with your first petition.I agree you are going to need a good lawyer to assist you in untangling this. The best way I think is for you to fight that but you will need your X wife to fight. that bar doesn’t apply to Vawa but your time already past. success Brother

@love u the time for VAWA already past because u re-married for 7 years now with two kids but they denied my I-130 due to previous wedding that Dey said it was a sham and I appeal the decision and they denied it because I don’t have enough evidence and my ex wife not willing to help or write an affidavit to keep fighting. I am just stoke up now. though I had an incident that occur recently that I am a victim of crime and my lawyer said I might qualify for U Visa which I am doing some research on it. though I don’t completely trust the lawyer I have because I feel she is not though enough for my case because she made couple of mistakes on my file.

@My P I gave them the evidence I had but they said it wasn’t sufficient enough to overcome marriage fraud. then I didn’t have a social and my ex wife couldn’t put my name on so many bills

@A M This is really unfortunate for you. On YouTube there is the Immigration answer show. A call in show where you can ask questions of the attorney. Even if you don’t hire them at least you may get a clear direction as your next steps. More information you have the better armed you are to make the best decision. Don’t give up, keep the faith something will work out. This community is a tremendous support.

@A M Earl Laidlow. 212 233 4600...He is in downtown Manhattan. Was an immigration officer for years before becoming an Attorney. I was actually referred to him by another immigration officer when I interviewed for my greencard years ago.

please note I was never in the same situation and was never married before, but he was an immigration officer before so he will know what to do.

A M, it’s hard to get a perfect lawyer, they all seem to be good till you pay them. This is my opinion, are you currently Working now? if yes, Continue fighting that accusation that the previous marriage was fake. continue making appeals to the current denial with your personal statements about the previous Marriage, if you can’t get your X wife, find her friends or siblings to write for affidavit

the more you fight, with applying again or appeals the more you make them believe that you are right. I wouldn’t recommend you filing any other different application, but to fight with a current application since your are perfectly married now. Make appeals or if they can put you in deportation proceedings and prove everything to the Judge, don’t fear many people win cases with the judge because even USCIS has to provide prove to the Judge that your previous marriage was fake which is hard to prove. They will never deport you since you have two kids and married. But the judge can grant you green card. I wish you success and just know you will make it

@love u thank you. I really appreciate so much. I was able to reach out to my ex wife and she stated that she is not willing to help me and there is nothing I can do on that aspect. I spoke to a lawyer today and she stated I qualify for U visa which I will apply and also apply for a waiver due to the marriage fraud on my file
