Advice on filing Writ of Mandamus
I’m here again. I spoke to my lawyer today, and I’ve already explained my situation in my last post. If I proceed with my lawyer to file a writ of mandamus, he will charge $5,000 plus court fees of $405. This is a significant amount for me, considering that I’ve already spent more than this amount while filing my case for my marriage-based green card. My lawyer informed me that after filing this writ of mandamus, USCIS must take action within 60 days. He plans to sue them if they fail to respond. He had already filed a pre-mandamus on August 2026 and gave them 60 days to respond. The only change I’ve received on my I-130 is that USCIS is currently processing the case. On my I-485, I received a silent update about a FBI notice. That’s all the information I have. Now, my lawyer is going to actually sue them. It’s just a lot to pay. Any suggestions or advice would be greatly appreciated.

@R T Hi, I have commented before. You can file this on your own. People on here have. There are so many great YouTube videos that can help you. Lawyers are not wizards when it comes to all of this. The lawsuit will force them to make the decision, not the lawyer. I am married to one and they don’t have special abilities when it comes to things like time frames. If you were detained, then you need a lawyer. If 5,000 is a lot for you, please look at doing it on your own.

@Kingsley B, Thank you for your time. I have already started preparing myself and will do it myself without a lawyer.
