@Mmls: not any more. My dependent case was closed because mine was closed then. And they won’t reopen it to adjust the status

@Mmls: Yea I brought the order to my field office then they reopen my case and adjudicated it since last year. A request to reopen was sent since then for my dependent. It’s been 10 months now, they never sent a receipt notice nor open it. A tier 2 officer says that this form should have been sent and needs to be filed now. I don’t understand that.

@Mmls: No they haven’t sent me anything about it. It’s been 10months since we sent it. The removal proceedings is all cleared. USCIS only needs to re-open dependent case for adjudication. But now a tier 2 officer is saying the request we sent was not proper and that this form should be filed instead.

This is all crazy. we didn't get to file the form because a couple of attorneys we talked to said this doesn't pertain to our case. We talked to an agent through Emma, we were told our original motion to reopen which was sent to NBC May last year is finally transferred to the field office and that we can interfile with medicals if we want to. We still haven't received no correspondence about the transfer or anything else. Another agent later on said the file was never closed. It’s all messed up that are so many people behind those calls to USCIS who don’t even know what they are talking about,

yes we received it 2 days ago. They didn’t release about 80 pages for confidentiality they say. Otherwise I don’t see much about this related case in there.

Oh ok. I thought you got it already. Well we requested the FOIA as people were saying in here it does make USCIS touch the file and found missing pieces that are needed for the case. But I’m not sure how accurate is that. Ours took about a month, from March 1st to March 30. Our file was transferred to local field office on or or about March 17. Besides the FOIA, we keep raising SRs, chatting with them many times a week lol, requested Senator inquiry and we even resent the motion to reopen to the local field office. We did a bunch of stuff trying to make it work on our favor and still waiting. I don’t care at this point which one of these will work, I just want to end this 5-year immigration process with USCIS out of our 12 years of immigrating here. I hope we all get some type of relief soon.

any unpdates on your cases? I’m doing an AOS and I have a son, my husband is adjusting for him too( he’s a minor) my wrk permit was approved and both his i485 and i130 were denied” the denied notice says’ no show for interview’ on the USCIS history no interview request is showing, file a montion they say. I rang and requested that a tier 2 officer call instead we got an email saying follow the instructions on the forms.

guys I have they 1 290b case file motion to reopen since August 2021 they mail me letter say they receive my appeal &incase they need biometric they will mail also I send Renew of my ead June 2021 and march 3 2022 I get update they close my form because beneficiary receive status true other means I don’t know what it mean I stress out so it’s being 8 months & 3 week now I receive letter that’s they receive my appeal and transfer my case to they chief officer at federal plaza ny & incase I need to make inquiry I should mail them

I have no idea why they transfer my cas to chief counsel office I’m worried never hear any one get transfer there

I didn't do what tier 2 told me to do because it didn't make any sense to any lawyers that I contacted. No updates on what was done yet otherwise some agents saying file was transferred to San Antonio field office while others saying it’s still at NBC. I’m just trying to forget about this and go about my life as this was getting me too anxious.

@ kimmy and Sassy J base on your experiences, should I file 1 motion for the each denied case? (i130 and i485) how did you’ll filed

@ lady D I think you need to consult with a lawyer first I don’t know much whatever my lawyer told me about she did base on my case

I don’t have no knowledge or experience about that. I only filed a motion to reopen an administratively closed i-485 with a letter which tier 2 asked me to file a I 290 for it but no lawyers I contacted understood that tier 2 advice. So I don’t know but people do say it takes a long time and a lot of time it’s better to start a new.

@lady D: That’s where lies all the mysteries. We have no clue when it was open. Motion to reopen was received in May 2021. A name change of status was made on June 21. Since then there has been no updates until yesterday saying case was reopened for reconsideration first then secs later it said we ordered your new card.

but in the meantime we did many little things. About 6 case inquiries (from Nov 21 to April 22) that we only got answers for only the last 2. We requests for A-file.. We sent in medicals in without RFE 😄. Then the last big move was the congressional inquiry for outside of normal processing. We also did expedite request on EAD + a Senator inquiry which was approved on 3/2.

also we had many many many chats at least every other day with Emma. we bugged them to let us know where was the case, it is open or transferred to the field office and why there was no reply on the motion sent since last year. Some agents say the “case was reopened” one day or it’s “transferred to San Antonio”, the next day another one say it’s “still closed” and “still at NBC”, to it “was never closed”, to “it’s at NBC”. It was tiring and frustrating. We even got a tier 2 saying we need to file a I-290B or the case will never be reopen. It’s been a very bumpy ride. Today being happy that its over is an understatement. I wish you good luck with yours.

@Ice Cream: Nope we never did. First of all, it didn’t seem right to me because the case was never denied. Secondly, all the lawyers said it was not applicable to our case. And yes, most of these USCIS contractors called tier 1 and even some of their own officers called tier 2 have no clue of what they are saying. They say something today, tomorrow someone else say something different. One of them even told us, our file was “assigned to an officer at NBC but not an adjudicating one”. One week later another one said he doesn’t see any information like that but the file is at NBC when we asked the same question. Then the letter responding our last case inquiry came from the local field office, then we kind of thought the case might have been transferred. But anyways, my spouse was so close to spend that money on the I-290b form out of desperation. But I’m glad I was able to stop that to happen.

Hi @sassyJ: I’m so happy for you! I know how much stress we have about this cases! It happened the same to me. My I485 was administratively closed and my lawyer is trying to reopened, we already sent the letter to reconsideration, let’s see what happen. But I’m worried because I send the form 2 years ago and I also did my medical exams 2 years ago. When they reopened your case, they request to send a new medical exams? Or yours were still valid? I am still waiting to hear from USCIS, my case was reopened 3 months ago, and after that, there is no update.

@Mabel Torres: I brought my medicals at my merit hearing as advised by my attorney. That was the third medicals I did 🤦🏾‍♀️. But I’m super happy and grateful to God it’s all over now. Good luck with your process.
