Yes, however the beneficiary would have to be in valid immigration status throughout the entire process. Eg. On an F1 student visa or H1B work visa. I know there's often some confusion because it's different for spouses of US citizens because if the beneficiary (spouse) of a US citizen is out of status, it is forgiven. Unfortunately that is not the case for LPRs.

Yes you would have to be in valid immigration status but not throughout the entire process. You just need to be in status before you file the case and to be on the safer side, until you receive receipt notice. I know because i've been through the process. Good luck
