Does USCIS check/confirm abuser US citizenship during initial review of application? How can I be allowed to apply together I 360 and I 485 and get EAD C09 and then after 2 years being asked to provide proof of abuser status? Have they confirmed that before issuing EAD and allowing me to apply concurently 360 and 485. They are so confusing? That happened to someone?
I saw that some people file concurently and get EAD C09 even if abuser was LPR, which makes me wondering do they check anything or what 🤨🤨

PS. I didnt get RFE but in my initial package i provided dob ssn full name and asked USCIS to verify their status since i dont have any document to prove their US birth citizenship. I was always worried if they will be able to confirm but I had peace of mind that they did confirm from the begining since I got EAD category C09 and i was allowed to apply 360 and 485 together. But then i saw on other forum that some people got RFE for abuser status after 3 years and after they got EAD C09 which is only available if abuser is citizen, which makes me questioning why they ask for that rfe if they gave C09. Also there is a person saying they filed 360 and 485 together and got EAD C09 even if abuser was LPR. does anyone know anything ? Thanks

You can only apply for work, travel, i-360, and adjustment of status if your ex-partner is a US citizen. If your partner is an LPR, you can only apply for I-360, and you will be able to apply for a work and travel permit till USCIS approves your case, and then apply for adjustment of status. Some people might have a work or travel permit because before marriage, they probably had other cases, such as asylum or a work visa; every case is different. But you can always hire a lawyer and have them verify everything for you. Good luck

Thanks :) i did apply with lawyer but was lacking proof that abuser is citizen. I provided dob driving licence ssn and name and asked uscis to check in their database to confirm citizenship . That was always bothering me , if they will be able to verify since i was lacking documents, but since i realized that my C09 wouldnt be approved if i didnt file 485 together which would be possible if she was not citizen, the fact i got ead told me that they confirm she was citizen and that i have nothing to worry. But i am confused now if they can again send me rfe to prove abuser status :) thanks anyway

@God loves you! ;) My abuser is a LPR and my lawyer filed I-360, I-485, I-131 and I-765. I got my first EAD 2 years combo card within 4 months of filing after it expired I got a 5 years combo card now my VAWA approved in 1265 days and I-485 transfer to another field office. NO REF and 6 PF

@simon irfan yes my lawyer said at the time I could do concurrently filing and that is what he did.

I filed January I360, i131, i765 and I have a pending i485 from my previous marriage which was linked to my Vawa but USCIS Issued Receipt notice Ead C31 category so my question when you think I can get my Ead and advance parole approve please I need response

@God loves you! ;) That’s not true. Abuse doesn’t have to be a US Citizen. Abuser can LPR.
