Hey fam i hope youâre enjoying your Sunday!
I have a question to ask..
A few years ago i was married to an abusive woman that showed me how hell feels like and thankfully weâve been divorced for about 2 years now!
- In Feb 2025 my lawyer have filed my VAWA I-360 alone without filing the I-485 saying that itâs safer to get the I-360 approved first and then he will file the I-485 just in case if the immigration denies my I-360 i would stay safe while if we file them both at the same time and they deny my I-485 i will automatically become in a removing situation and that would be a bad thing especially under the new system!
Even though he said that my case is solid and that my evidences are very strong!
My question is do you guys think what he did is the best thing to do or should i file the I-485 now because i kinda need a Work Permit and a real id!

Honestly Consulte a specialist lawyer in Vawa like Moumita Rahman or Sharifa Tharpe they will give you a good answer for your situation don't waste your time with that lawyer.

@Ammm Zouk Not filing I-485 sounds like you out of status. An I-485 wouldâve given you a period of authorized stay while your VAWA processes. I might be wrong but I doubt it.

my lawyer filed both at the same time and igot my EAD card few months after.

should have file both and you would get your EAD you canât get a real ID until u get the greencard though

I personally did back in 2022 and it was fine. I personally agree it is safer because a denial on i485 triggers deportations. filled 2022 approved 2025 filled 12/2025 applications pending still waiting for an interview or interview waiver.

omg ! Iâm so sorry for your choice of a lawyer. Iâm so frustrated with how lawyers in this country are so incompetent and stupid. you should file your I-485 and other forms ASAP and get your work permit. I recommend you to send your medical with all forms. I filed my 360 then after 2 months my all other forms. donât listen to your stupid lawyer is such a mess.

I did not file I-360 and I-485 together because I will they may deny it just like your lawyer said but as soon as I get the prima F. He filed the I-485 and I got the work permit.
prima F means your case can get an approval at this time. if you are already at removal proceedings you canât file I-485 at this time.

you need to apply i485 with c09 work permit category you will get work permits about 7/8 months. you canât stay here without this. 360 took more than 4 years how you are gonna stay all those years. find another lawyer if you believe your case is strong.

@Somiah Ahmed under vawa or marriage, you can apply expedite if it is marriage base. vawa took more than 4 years, 2 years is nothing for usđ

Maybe my lawyer thought itâs safer becuase my I-130 got denied a couple of years before my devorce was done!
and a few months after my devorce i filed the I-360
My I-130 was denied because my
ex-wife stupidly answered incorrectly on some simple questions they asked her at the interview! So they denied my I-130 and said that we didnât give them enough proves that our marriage was real ( Although they did not assign it as a Sham marriage) I was supposed to file a new I-130 as my lawyer recommended but i did not because she was mentally unstable and physically + mentally abusive (Which my VAWA case is based on) and for those reasons i couldnât any longer stay in that marriage.
