90 day rule for AOS
I know that you cannot get married to a US citizen within 90 days of entering the country or it will be a voilation. Does this also apply on getting a marriage license?

as I know you can get married as soon as you like, but you can’t file for adjustment earlier than 90 days

my friend had her marriage with US citizen on her first month here (on B2) and got no problem. she has 2 yrs GC now (conditional). I believe that as long as it is a genuine marriage, there will be no problem.

yes, it’s absolutely legal to get married when you like. lots of my friend do the same , get married within even 1 month after arriving.

I married in 45 days and sent my papers, but luckily my documents came back bc I sent something wrong and it was my lucky. then I hired a Paralegal and she explained to me I would have problem if they had accepted my case. now it's going smoothly and I'm waiting for the interview.

the problem was not that you got married in 45 days, but you send papers earlier than 90 days.

@katerina yes exactly. the problem is to apply for the GC before 90 days, they will see that you had intention of getting married and for that you should use the K1 Visa

@vi vi so you married within 45 days on a B2? how far along are you in your application process? so technically you can get married in 90 days but don’t just file

@Farhan Azhar you can marry any day, he proposed me and and decided to get marry asap bc due the pandemic we were apart almost one year. we have a solid case for defend yourself at the interview. you can marry, but you cannot apply in less than 90days. I didn't know that and I sent all the documents in 45days after our marriage, but thank God I made some mistake and the whole process came back. So I hired the Paralegal to do the job and was our lucky, she explained to us this rule that we really didn't have any idea. 2 naives 😬🤷🏼♀️

I have been on a f1 status for 6 years and got engaged last year. this year I went to visit my family so my wife. (US) citizen meets my family. so after we got back … we got married (just civil) and couple months later we filed for the greencard. I definitely got married within the 90 day. lawyer said… I was fine to get married after my trip…. so this rule is not law but it may be used for certain cases. I just got my combo card and now waiting for my greencard.
