7 January 2022 PD - Approval - Writ of Mandamus Filed
I wanted to let anyone who sees this know that if you are beyond regular processing times and are financially in a place to afford such a large expense, don’t waste anymore time and file a Writ of Mandamus.
I literally took advice from someone else on Reddit, a stranger, and I am so grateful and happy I did. So this is why I’m posting all of this, to hopefully help inform someone else that’s in a similar situation and help them find resolve and peace!
From signing the contract, to having our I-130 and I-485 approved, it took a total of 22 days. Once USCIS received notifications from the US Attorney’s office, on a Monday, quite literally the next day, Tuesday, our case was approved.
Additionally, the immigration office we are working with keeps our lawsuit open with the US Attorney until the Green Card is produced and delivered. The case won’t be closed until that happens.
The immigration office we are working with (Hacking Immigration) charged $5k and the processing fees are $500 (government related).
After trying to patiently wait for the Fairfax, Virginia FO to process our paperwork, we felt helpless and decided to go this route… 870 days later.
Regarding our timeline down below - it’s all corrrct except for the RFE part. We received an RFE, but within minutes, we received another update not reflected in the timeline that stated the RFE was cancelled. Later we received the interview notification.

@shaq David They requested service id’s associated with our service inquiries on the USCIS website, and a copy of our ombudsman requests. We skipped the congressional route, but we would have provided that too. Honestly, we provided the same documentation we were required to send to the Ombudsman office.

@José Mario David Suazo The number for the office to schedule an appointment is 314-690-7391.
I spoke with an indoctrine specialist, named Rommel, who made sure my case fit their criteria.
Afterwards, he scheduled a meeting for me to speak with their attorney, Matthew Parolie to get into further detail.
The final step was then working with their paralegal, who’s name is Pilar.
All of them were actually wonderful to work with, like unbelievablely professional and responsive.

@shaq David Also - what I’m about to say is only my opinion/speculation, but I don’t think USCIS investigated the “evidence” regardless of what our lawsuit stated. I think they simply assign the case specifically to an officer and tell them to make it their priority to approve or deny it asap.
So what I’m trying to say, is the evidence USCIS already compiled for and from you is all they seem to consider to approve your case, even after they receive the lawsuit. If they need more evidence or an interview, of course they’ll tell you. But yea, for us it was just approved instantly with no further requests.

@shaq David I mentioned above how much it costs :) But my personal opinion is you don’t HAVE to… but it certainly wouldn’t hurt because the ombudsman option you can file on your own for free, with some patience and effort. But again, I really don’t think it matters; I believe USCIS knows when a case is overdue and will look to approve it after receiving the lawsuit.

@jiya p If your lawyer filed and submitted your Writ of Mandamus on 1 June, my guess is that you will hear something by the end of this week. If you don’t, my next guess is that you will hear from USCIS at the end of their 30-60 day suspense date.

@jiya p My opinion and best guess, is that your case was managed poorly and your original field office lost it or doesn’t have the manpower/resources to complete it. So them transferring it to a different field office intentionally is to make sure someone completes it.

@Bella O Hello. yes we worked with hacking and my case was reopened and we got our greencard after that. I recommend contacting him if your case is strong lawsuit case
