500 days of silence for I-130. Is there anything I can do?
A little bit of background:
I was in removal proceedings. Got married. Filed I-130 (standalone) at the end of December, 2021. Waited for a year for any actions to be taken on I-130 form - radio silence. Terminated removal proceedings on March 2023. Filed I-485 at the beginning of May. Now it being considered as concurrent filing (I-130 + I-485). Talked to Emma chat agent and have been told that both cases are at NBC (not sure what timeline for NBC is - I guess nobody does). Since I-130 has been pending for almost 18 months, I submitted service request (heard it’s quite useless though). Not sure if there anything else I can do to speed up the process…Please drop a comment if you have similar dates/experience. Receipt: IOE914.

u should focus on I-485 instead. since your removal is terminated, u don’t have to worry about I-130 getting approved. the goal is to get I-485 interview and hopefully I-130 adjudicated together. that’s my 2 cents. since you just submitted I-485 in May depend on how busy ur local office

@waiting forever depend. some local FO did more interview than the other. I’m not worried about it, as long as I can get the greencard, I’d walk on hot coals if needed 😂I ain’t scared with interview

@waiting forever she’s married to a GC holder. usually USCIS will de-prioritize the I-130 approval of cases like that. even for people married to citizens and in removal proceedings it’s still take long time, just not as long.
so to answer your question, can she try to terminate with pending I-130 ? she can, but even with approved I-130 it’s always a gamble

I think you should focus more on I 485 now since your removal has been terminated and that’s the hard part . your I 485 will be adjudicated in due time just relax . good luck

@domino 23 i’ve been under deportation for almost 10 years in September my I-130 pending since june 2020 and final court hearing in September this year. smh 🤦🏽♀️ do you know anything about Ombudsman??

in my experience, ombudsman never been useful (for my case) since u file I-130 in June 2020, does ur spouse plan to be USC ? as you know they treated I-130 while in removal, differently. even in USC case still take 1,5-2 years minimum. @Elsa Carvajal but since ombudsman is free, go ahead and try. better to try then not knowing
