6 Primie Facie
I just got my 6th Primie Facie. I applied for VAWA since 2020 December. I started with a lawyer, my lawyer was so nonchalant and always forgot about me and my case every time. He also was not sending me any documents from USCIS. I had to write to USCIS to remove him. Now, I have no attorney on my case. could that be a reason I am yet to get a decision. The processing time is currently 35 months, mine is 33 months now.

@Charlaprince princelachar you must retain with an Attorney even if you don’t have an Attorney then uscis will take it softly and possibly you get denied! please hire an experienced Attorney and don’t care on money coz some people think it’s easy but literally it’s not and it’s very tricky case my dear !

@hope courage Thank you for your insight. My question is, what would I need an attorney for at this point of my application process? My plan was to wait for November when it’s 35 months and then reach out to them. Right now, I am thinking twice.

@tired from waiting @Charlaprince princelachar when you have a lawyer that means your lawyer is responsible for any consequences on your case and fix any problems that arises but when you don’t have a lawyer that means you don’t have anyone to save you back specially when it comes to a Uscis unless you are too lucky. your lawyers should inquiry your long pending cases and take further step because you paid them to help you . after all if your case is outside of normal processing then you can file mandamus or other legal action but make sure you talk to your lawyer .

You don’t need to panic, either you have a lawyer or not that will not speed up the processing time. Your law firm will not skip your position on the waiting list to get you an approval. Please everyone here should know that getting lawyer is by choice and does not guarantee approval. Some law firm will even tell you that because they are not USCIS. If you know how to file and what documents to attach you will get approval without lawyer. Don’t forget that if you use a lawyer it’s also same thing they will do. At this point of your case please reach out to congressman. they will take it up from there and you will get approval soon.I see that you will be an approval soon before the end of the year according to the timeline you shared.
I repeat, we all don’t need to get a lawyer for our case to get approved .

@Charlaprince princelachar @tired from waiting, Read @manny pop advise again. It is not a must that you get a lawyer, and retaining one does not prevent denial or guarantee approval. For you to get a Prima Facie, you have already established a case.

I applied I-360 on Sep 2020 and got approved about 2weeks ago. your is almost there so hang in tight! processing time is 35 month and knowing that your processing time has been passed, reaching out to congress won’t be much help at this moment since earliest you can submit SR is Apr 2024…. I know it is waiting game but trust me, yours is coming soon.

@manny pop where did you get that idea that you don’t need a lawyer ?? I know some people are very cheap even to hire a lawyer and think like they could win but in the reality it’s not true ! vawa or other immigration cases are very complicated and you don’t know where you will get stuck and that will ruin your future immigration benefits. To draw your attention just imagine : when we feel cold or fever we know by taking some Tylenol or advil we can overcome but we are literally not doctor and eventually we go to the doctor to get well so same like uscis cases that you need an Attorney at some point to give you a safe option .

@hope courage , is there a page on any USCIS form that states that this form must be submitted or file by an attorney? NO.
It’s not about someone is cheap or not, it’s about knowing what to do. If you know how to fill out the forms ( Any USCIS forms ) and you have the supporting documents to back your form up, believe me your case will be approved.
I have a friend who is now a US citizen whom we both sat down together and fill out his i130, i485 and i785 together back in 2016. Right after that I can count about ten or more people that have helped in filling their cases and they got approved.
The trust is that you only need a lawyer if your case is going south or already gone south that’s all.
To renew EAD or combo card is very simple and easy but most people don’t even know, same as to file any case. All my EAD/Combo cards are always done by me. I only used an Attoney for my Vawa because I was transitioning from i130 to i360 and don’t know anything about Vawa then.believe me I used that as an opportunity to learn how it’s done and I can tell you with my full check that I can file Vawa for someone and the person will get approval.
once you know how to fill the forms and documents to attach USCIS don’t care if it’s an attorney that file it or individual. Meanwhile I am not saying it is Good or bad to use an attorney, rather my point is that you don’t have to use an attorney before you get approval because using an attorney will not guarantee an approval from USCIS

@hope courage If USCIS is having an issue with a case, whether you have a lawyer or not, they will still mail you a notice explaining what is wrong, and you can decide whether to involve a lawyer or not to resolve it. The whole point is that it is not a must that you use a lawyer when submitting a case with the USCIS, and retaining one does not guarantee getting approved or denied nor give them the leverage to deny, so long as you are able to fill out your form appropriately and attach enough evidence that proves your case. A good lawyer will even tell you that helping you does not guarantee approval.

1/26/21 response to RFE
9/12/23 I-360 approved
I have received 4 prima facie I believe but never used it so . you are more than welcome to ask any question if you have!

I see some people received RFE for good moral character. i wonder it was not enough for uscis and they want more proof for good moral character. please let me know. thank you

@skylar . yes I submit good moral character as well to show that you have no criminal history which is police clearances for everywhere you've lived for longer than 6 months over the past 3 year.

@stacie k thank you for sharing your experience. I submitted my Vawa with police clearance where I lived for the past 6 months to 3 years. I wonder why they asked you to submit more and what else if I can submit in case they ask me more . did you move after filing i360?

did USCIS asked you to send another good moral character besides police clearance report? did you send your affidavit along your initial I-360? if not, sending it would also help. But as far as I know those two document should be enough to provide good moral character. and no I haven’t moved since I file I-360
