300 days since submission and 200 days since approval
hello community,
I have an approved i-140 (row) with Nov-2023 PD and it has been over 300 days since I filed and 200 days since it got approved! i am still not able to file i-485! this is ridiculous and I don’t know when I will be able to file i-485 if ever! backlog is crazy!!!

If you want to file 485 asap, you should try EB1? The EB2 backlog for ROW will be more huge than ever before. My PD is Nov 2022 for EB2. I waited almost 1 year to file. If US doesn’t reform immigration, the later PD will experience a longer wait time to file 485 even applicant is from ROW. Sooner or later, ROW might also have cut off date for EB1.

what’s ROW ?
Antonio SandovalSep 30, 2024
row = rest of World. My PD is nov 23 and still waiting approval
adam smithSep 30, 2024
@Jk n you mean October 2025? that will be almost 800 days of waiting
adam smithSep 30, 2024
@H N what will happen in two weeks? can I file aos?
adam smithSep 30, 2024
@Jim HSU i don’t know if I qualify for Eb1? but I waited almost one year and still can not file
Jim HSUSep 30, 2024
@adam smith EB1B should be easier. If you can pass NIW, EB1B is doable. Yeah. I was very surprised that I can’t file 485 when I got 140 approval. Unless they increase visa number quota per year that is set many decades ago, the backlog is getting worse.

@Jk n interesting. i just need table b be current so that I can stay in us legally. my stem opt expires in Nov-2025
adam smithSep 30, 2024
@Jim HSU someone has to sponsor you for eb1b. i don’t have any company or school doing that for me
Jim HSUSep 30, 2024
@adam smith I see. EB1B needs sponsor.

in my understanding is that right now USCIS tries to play it safe so there won’t be any retrogression. I expect and hope that next few months (by the end of the year the filling day will reach the maximum month so that the final action day can reach to.
adam smithOct 1, 2024
@iordanis kesisog thanks! so you think dates of filing, which is at August-2023 as of now, will move again?
iordanis kesisogOct 1, 2024
Correct. Logically thinking it is simply not possible for the government to allow a higher backlog than the year before. What has happened before is to not allow further eb2 applications so that the backlog to decrease. I really believe that we will see a couple of months of jump in November and another one as we move from December to January. I don’t really care about FAD as it is more important to get a work permit and travel visa that is possible when you file for i485. if anyone has another opinion about the day movement please feel free to share
adam smithOct 1, 2024
@iordanis kesisog i hope you are right in your logic that government does not want to increase backlog but I think backlog is growing every day. i also hope that there is some more movement in coming months but I think August-2023 might be the maximum they will let it move.
