3 years rule for LPR (vawa)
Hi everyone,
I got my green card approved in December ‘23, then I got married last month. I contacted my lawyer to start the petition for my husband but my lawyer said that we need to wait (either 3 years or until I became citizen) because I got my green card through marriage (I got it from Vawa, so I don’t know if that makes a difference with that 3 years rule)
I have read in some forums that that law doesn’t apply to green cards through Vawa. Also, I read that I can apply if I can prove that the previous marriage was true.
Does anyone knows anything about this?

I think what your lawyer is saying is, since you haven’t gotten to be a citizen yet with the intent to file for you man, you might need to wait for three years to be a citizen then file is green card. my question is did they give your green card yet? if yes I’ll say you could file for him without your lawyer . tbh

My lawyer said I can only apply for citizenship if I marry again another US citizen and we live together and etc as a married couple. Then I would be able to apply for citizenship within 3 years, if not just in Oct of 2028.

By the way, permanent residents can apply for another person, but usually it is goes faster with your citizenship in hands. If not, your husband is gonna wait a little longer than immigrants married to US citizens.

@D K if your spouse out is states or cross border then u have to wait until citize.
