290b motion & refiling
My 485 was denied because USCIS missed our document.
we’ve sent the Rfe response but they are saying that they haven’t got it.
has anyone did both?
refiling 485 and Motion to reopen?
We are out of status so we need to do something ASAP.
what would you recommend doing and also,
did you stopped working while pending 290b?

How can you refile I-485 if you are out of status?
As it was USCIS error, there is a high chance your motion will be accepted. Provide as much evidence as you can to show that the RFE response was sent and delivered.
You can keep working on the presumption that appeal will be accepted and you will be fine.

If you are employment based, never work beyond 6 months after the denial date as it can bring bars. To be on safe side.
