245k rule / resubmitting 485
I have to resubmit I485 form. using ina 245k rule.
Does anyone has experience with that?
What should I write for the questions like
overstay and unlawful work questions.
I am out of status now less than 180days so I am going to file again
any tips/ experience with this?

You don't need to write anything. USCIS will automatically forgive less than 180 days violation. For overstay and unlawful work write yes and explain in last sections that date from and up to which you did unlawful work or overstay.

@Charlie SC They say we didnt reply to RFE. which is not true. we also did a motion with the proofs but they dismissed. My lawyer also can’t understand. We are going to reapply asap.

@Charlie SC but does someone need a form for the 245k rule because I’m also in the same boat worked unauthorized for 2 months from June to August of 2019. I still don’t know if I’m supposed to answer yes or no for that.

@olu mikk You have to answer yes. Write whatever is true. USCIS will forgive less than 6 months violation automatically.

When you attach your I-94, it shows when your last stays ended. Then you mention you worked up to what date. If you have a termination letter, you can include that. If not, they can send RFE of they really need a proof.

@Charlie SC I’m currently on F1 and the end date of last stay is D/S. The unauthorized employment took place in summer of 2019(June to August) when I was doing my masters degree but now I’m currently doing my PhD program.
