20 months waiting no rfe nebraska
Hi everyone,
I filed my I‑140 EB‑2 NIW at Nebraska Service Center with a priority date of December 2023. Today marks about 600 days (20 months) with no RFE or updates.
I’ve seen that many similar cases are being approved around 20‑22 months, but I’d like to know if anyone else is in this same timeframe so we can compare and see if our batch is starting to move.
Anyone else with a 2023 priority date and no RFE still waiting at Nebraska?

Hi! Thanks for sharing your timeline. My PD is December 6, 2023 — also Nebraska. I haven’t received any RFE, just waiting in silence, and today marks about 600 days for me as well.
I suspect my case might have gone into some kind of additional review a few months ago, which could explain the long wait. Do you think yours might be in something similar?

The long wait time is expected since they are processing very few regular processing cases every day. My conjecture is that if a case passes the published processing time, it will never get processed and once its PD is current they know for sure you will do premium. In other words, we are supposed to do premium processing like what all people are doing now.

A month ago I thought about paying for premium processing, but my attorney advised me not to. He said that if I did that, most likely I would immediately get a generic RFE, which would automatically add another 4–6 months to the process.

same here, pd Dec 01, 2023- no update since they recieved my case!

out of 4045 cases in the 09233 block, there are 279 cases that are still being processed and 39 RFE’s which have been answered, the block had kind of movement last week, around 35 cases got approved in one week!

@pedro momtoya Sadly my friend there is no other way. There are still more than 700 processing cases from Dec 2023 and averagely only 4 cases are processed per day in the last week. You can roughly estimate how long it would take for officers to process all the Dec 2023 cases. By then your PD may have been current already and we will just pay for premium anyways to do AOS/IVP. Note that 4 cases/day is the ideal scenario, it can be worse, lengthening the process by 2, 3 times, who knows.

My PD is July 2023! They sent me RFE in August 2024, I answered the RFE in November 2024, and nothing after that. I chat Emma and my case is in NEBRASKA, I already filled 2 inquires since my case is out of the timeframe! Still waiting 🙏

@Duc Hoang Total cases with no definite answer for December 2023 is 1400 cases, out of around 15000. Mostly did premium. 4 case a day means next 400 days 😂

@Cristiane a i think it should be time to do pp… your pd had already been current. may i know if your rfe was sent to Nebraska or Texas?

@Hadi R yes it looks so hopeless with this current processing rate. unless something changes, this will keep being like this or getting worse. In the mean time, I better prepare the money for premium process as the new fiscal year is coming. 🤣🤣
