I have a question about this, I got married August 2021, I filed I 130 for my husband in November 2021 they approved it January 2023, my husband is applying via consular process abroad, we've been documents qualified may 20 2023, waiting for an interview, August 2023 will make our marriage 2 years. Which will my husband be getting when his visa is approved 2 years or 10?

It depends on when he makes it here and green card is issued.

If he makes it here after August which is more than 2 years of our marriage. What's he gonna get 2 or 10 years?

@Ck Ck if he get approved after August he will get the 10 years if he get approved before then it's the 2 years so we in june now more likely he will get 10 years because of these backlog

With consular processing the relevant date is when he first enters the US on his immigrant visa. if that is after your second marriage anniversary, he will get the ten year green card, independently of when the visa is approved. As the immigrant visa is valid six months or so from the date of the medical, I’d say you guys are home free for the ten year green card.

@K C 4 months but I just responded RFE (medical exam). I’m not sure about interview, it wasn’t schedule yet.
