140 NIW approval + 824 approval (change from AOS to consular processing) - Texas Center
Hey guys, I would like to share my timeline with the approval time of my I-140 (NIW) and my I-824 requesting changing from AOS to Consular Processing. Both are Texas Center and I haven’t requested to expedite.

congrats! was it your own choice to switch to counslar processing or it was difficult to adjust status? asking to see if its safer and faster to do counslar from beginning

My work visa was about to expire and combo card would not arrive on time to the expiration. So we decided to come back to our country and be able to continue working remotely to the company in US. If we have stayed in US, we should have stopped working until combo card be in our mail. Probably it would be a gap of 8 months not working what does not make sense for us with the possibility to still working with no economic impact in our country.

Mona my advice is send your 140 as consular. Despite it is consular, if you decide later to adjust status, there is no additional bureaucracy, you just send 485 normally. However, on the other way, if tou start as AOS and decide to change to consular, there is 824 in the middle….. and it takes a long time. So, Today I say this to everyone, start 140 as consular in all scenarios because it has no impact in the AOS.

@ Lu X thank you so much, this is the best advice ever. I am in a similar situation but lawyer insists to go i485 route and not counsling thinking its a high risk to return. thankd again and good luck hope you hear back soon.
