130 pending and still the cycle is ON? why?
hello folks
I filled my I130 in 2021, never had interview.
my spouse left me with no choice but to file I360 in Aug 2022. and unfortunately he passed away in mar 2022.
today while checking status I notice my I130 is still active and number of days showed 1200+ and it’s sums up with every day.
at the same my I360 is ON too with 800+ days
received EAD , AP, And PF
would there be a problem later with this? I am confused when we convert our I130 to I360 do they both run parallel? please help with your expertise
my lawyer has a bad attitude whenever I ask him in questions , though payed him full fees in advance

You will get approved just hold on. It seems like most of these lawyers who don't do much to help their clients with gathering those documents that are requested by USCIS but just wait to sign and stamp then later mail it act the same way after they received our payments. They don't respond properly to clients who are already downhearted due to the long wait time. it's 😔.

@Vawa 2022 applicant You shouldn’t have any problem as the Vawa process is independent of the marriage filings you did, moreover your marriage case officer cannot know the underlying basis of your Vawa case as it is under a protective seal but would know the outcome when it is determined by the officer in charge of your Vawa case. I would advice that since you have both cases processing you should have separate I-485 for each so as not to get to a point they tell you to file another I-485 for your Vawa since your marriage filing precedes your Vawa. Some will say you can’t switch your I-485, so to safe time if you don’t have an I-486 adjustment for your Vawa I would advice you do that as you can have two benefit petitions processing at the same time. The worst that can happen is you withdrawing one later when your Vawa gets approved or your I-130 gets denied.

@bridges 5 also for I130 lawer never filled I485, but for I360 the other lawyer did filled I485 concurrently along with EAD and AP .

@Vawa 2022 applicant It’s a long waiting process, so you just work while you await your I-360 petition approval. They may schedule an interview for your i-130 within this period, so you will have to go and inform them when they give you a date that you have filed for Vawa which they will eventually deny. You can also travel home but inquire from your lawyer or seek legal counsel to be sure you don’t have any issue they might use to deny you entry if you do travel out of the country.

I applied I130 in July 2021 and no interview was scheduled.
do you think they already know I converted my application to I360? also it’s been three years if this the case why it took so long? for them to schedule me interview

@Vawa 2022 applicant Technically they have to schedule an interview with you to deny your I-130. On the other hand if they see you have a Vawa petition on file I would think it would give them more reason to invite you for an interview to give you an opportunity to clarify which petition you want to proceed with thereby issuing a NOID and then deny your I-130. Having a marriage based application since 2021 means nothing, there are lots of people who filed before you and haven’t gotten their benefit. I know several who even went for interviews 6 years ago and still don’t have their green card. The system like we have been hearing is broken, our prayer is for ours to be resolved with benefits rendered so we can function as an integral part of the American populace.
