@waiting - January 2022 don’t panic, I know it’s looking and sounding bad but trust me, it’s not that a big deal. Just carefully read the denial notice. Maybe u missed a RFE , incomplete I-864 ( affidavit of support) or birth certificate etc….. U have 30 or 33 days to fix it. Take your time and read your notice and if u still don’t understand it , take it to a lawyer or a paralegal and have them check it. From there u can decide if u want to reapply or just file a I-290b ( MTR) . U will be fine. I wish u all the best, and this is from someone that has been there.

@waiting - January 2022 I filed a motion to reopen, I am also from 2022 . There was an error in my I-864 but instead of sending me a RFE , the officer handling my application decided to just denied it all together. So I filed a motion’s to reopen with a new I-864 . The motion was granted and my I-130 and I-765 were approved, now I am waiting on my I-485 to get approved. But if I did know what I know right now, I would have just reapplied all together. If u find the reason why they denied yours and it’s not a big thing, I advise u to just file I-290b , because right now, they are processing them faster than when I filed it.

@felasky God is good 🙏🙏🙏 I honestly don’t know why they denied my I 485. my i130 is still pending.. all my denial says is “USCIS records established that on April 25, 2024, USCIS denied the visa petition filed on your behalf. You have provided no evidence to indicate you are immediately entitled to an immigration visa on any other basis” They gave me no explanation so I’m not sure if I should file motion or resubmit but hopefully you’ll be approved soon since your i130 got approved 🙏🏻

Yes it is related to i130. Read the line that says on April 25, 2024, USCIS denied the visa petition filed on your behalf. Thats I130. You need to go see a lawyer with the decision.

@waiting - January 2022 Your I-485 automatically gets denied if your I-130 is denied. You need serious assistance from a very knowledgeable lawyer.

My i-485 was denied on10/05/2023 due to uscis saying they didn't receive my rfe response i-693 medical records exam which I did submitted... I filled i-290b motion to reopen/consider on 11/01/2023, I attached a new medical exam, the receipt from USPS tracking which I use in forwarding the earlier medical records exam, a cover letter from NY attorney, a letter written by myself ,screenshot of my chat with live agent through Emma. To the glory of God my green card was approved on 04/27/2024.

@waiting - January 2022 Alright let me clarify this for u and everyone else in here, I am not a lawyer and so I am not giving u or any one else in here a legal advise . Now with that said, let me ask u 1- Was your wife with u at your interview ? I can tell u with certainty that your I-485 was denied because of your I-130 Your spouse withdrew the petition for immediate relatives or u guys miss ( didn’t receive ) a RFE and the deadline for responding passed. From everything that’s written in your denial notice, it’s clearly indicating that your I-130 was denied. And the I-130 is the underlying application to your adjustment of status. Meaning your I-485 doesn’t hold any value without an I-130 backing it up. This is specific to just your case, because u applying as an immediate relative ( family based ) . Now u can call USCIS with your spouse present to ask questions uniquely about the I-130 status, or talk to your spouse to figure out what really is going on or go waste some money on some lawyer, that will probably take your money, knowing he can’t fix sh***t about it . If u still have the copy of your I-130 with u . Carefully go over it again and read it thoroughly to make sure there’s nothing wrong or missing in it. Then talk to your spouse. If everything is fine at that level, then reach out to USCIS to find out what happened with that specific application. Good luck to u

1 month ago my i130 and i485 was denied..the reason was that my wife and I didn't come to the interview uscis scheduled but we were at the interview and the interview was ok..I talk to my lawyer and we fill motion to reconsider..I m still waiting...so you have to find first why they denied your case before you know what to do...good luck..in my case it's uscis error

If your marriage is still intact, I would say refile. But make sure to consult with a lawyer.

@felasky God is good 🙏🙏🙏 my husband was with me at the interview yes. I’m assuming the i130 was denied due to insufficient evidence most likely but thank you for all your help! I will most likely just refile everything and submit every type of evidence I can this time around bc both my husband and I were nervous during the interview and missed a couple of things.

@waiting - January 2022 Yes I believe that will be the route to take. But before refilling, if u are not in no hurry , I would ask my husband to do a FOIA Request for the I-130 , since he is the petitioner and that way, you’ll find out exactly what was the reason for denial. Because right now we are just making assumptions. It will take only a month to receive your request if u guys do it online. I sincerely wish u the best outcome. I know this journey isn’t always easy but u will get there in challah.

but I have a consultation with a lawyer on Monday so I’ll see what they advise me to do.

@Jackson U just spoke to my lawyer and she said USCIS indeed only denied by i485 and it was bc of an issue with my I-94 so I’m most likely refilling.

Dex 2022 here also.. I filed an i290B for a denied i485(missing sponsor form) and it was approved in 2months..the i485 was reopened and combo card approved..i130 still pending

@angie Antunes hey, I haven’t done anything yet but the plan is to refile everything bc they told me the denial was actually a noid and they said I didn’t reply to the noid so they denied my entire case (they never sent me a noid) so now my lawyer is going to refile everything for me next week.
