Willful Material Misrepresentation Case
Hello guys!!
I have applied I-130 for my husband and it’s pending. My husband had applied for tourist visa back in the day and mistakenly wrote ex-wife’s name instead of mine while we were married.
this might be considered willful material misrepresentation. How serious is this?
I am so scared. Has anyone faced this issue? And gone through waivers form I-601?
Please help. does this mean my i-130 and my husband visa likely will be denied.

Won’t be denied. just have to show or prove hardship. it’s best to find a good immigration lawyer to help you out with your case

@DaRainMaker thank you so much for the response. I do have a lawyer but just wanted to see real people who had this situation. Do you know success rates for waivers? and how long it might take?

I’m waiting on my wavier that I started since May,2021. At that time, it says it will take up to 7months. so I was waiting till the 7months comes so that I’ll call them and tell them my case have past the normal processing time. When I was ready to call at 7months, I check the dates and it changed to 8months. So I’ve been waiting for a month more so I’ll call them and it change again to 9.5 months. As much as it sucks, I have no choice than to patiently wait till 9.5months comes so that I’ll call and I’m just praying the processing time doesn’t change again. Best of luck to us all🙏🏽🙏🏽🙏🏽

thats awful. They dont make it any easier for us 😔 I hope we all get approvals soon.
I am still in i-130 stage and dont know if this is the step they will reject or when the case goes to visa center but I am mentally preparing myself for the worst.

Oh No I meant 9 yrs dealing with this whole immigration thing but the i601 have been for only 7months now

why he put his ex wife nAme? that's lying to a immigration officer .Is weird he mistake the names.if he put her name instead of your name for his visa don't be denied is fraud
