yes, I received my second one this month already. First one was for one year. Second one is for 6 months. I hope my case will get approved before the expiration of the second Prima Facie.

most of the cases they asked for RFE before they make a decision, expect anything from them . hopefully something you have it so you can overwhelm.

I’m very glad for you! You’re lucky that you managed to get a license without those documents. In my state they issue only until expiration date of PF or work permit. In my case, my driver license expires with a work permit in June. I hope to get some new documents from USCIS before the expiration.

My lawyer advised me to wait for the approval decision because in this case they issue EAD automatically. If I apply for work permit and travel permit now I would have to pay about $1000 fees... Unfortunately I can’t submit a fee waiver request anymore because my income is slightly hire than the requirement.

I filed my I485 based on pending VAWA and I received a C9 category EAD with a fee waiver. In order to reapply I have to submit a payment again. How did you manage to reapply without a payment and a fee waiver request?

c9 is free , I renewed mine based on my I-845 pending .

My ex spouse is a green card holder and I didn’t have an EAD while married, only pending I130. My lawyer filed for I360 alone, then after divorce we filed for I485 when it was allowed for Greencard holder spouses to file at the same time as for US citizens. My I485 based on pending VAWA, but I have a C09 EAD. I don’t know why, but I just checked my card and that what it says. As per my lawyer in order to reapply for EAD and apply for travel permit I have to pay the fees or file for a fee waiver. Please help to figure it out.

my I 485 is pending from my previous marriage and it never denied cause I asked the USCIS to hold it until I file my vawa . don’t listen to your lawyer , you can renew your EAD free and you can do it yourself too .

you can travel too , when I went to my interview with my lawyer when my ex never show up , the supervisor told me you can travel and see your family and don’t listen to other people.

lawyers most of the time specially in vawa cases don’t know that you can have a work permit while you are pending vawa . they confuse between C31 .

No, my lawyer was able to get an EAD for me with C09 category while VAWA is still pending. But my card is not valid for Re entry to the States, so I can’t travel. Do you think I can apply for EAD with advanse parole now without any payments?

apply and it’s simple form , you don’t need anyone to fill it up for you . I do that for myself without my lawyer too .

Haha Krish, you’re absolutely right. Sometimes I feel like I know more and can give a better advice than some lawyer asking thousands of dollars for that. Struggling with all this petitions for such a long time gives us so much knowledge from our experience of reading forums, chatting with each other, which not each lawyer puts time to. did you submit these documents at the beginning?

Yes, we did submit a lot of documents, but they say it’s not enough. for example, I had 3 reports from 2 different counties where I lived and from my country that I don’t have any criminal background, but they want to have it on my maiden name and on my spouse last name. So I will have to obtain FBI fingerprints records. For the marriage they also ask for more friends references, insurances, utilities, etc.

Yes, they specified what they accept as the evidence: - joint leases, mortgages - insurance polices with account maintenance with both names listing a common address - utility invoices with a common address - bank statements listing a common address - detailed affidavits of friends verifying the relationships - evidence of courtship, wedding, residence, events - evidence of joint ownership of property (home, car, etc) For moral character: - employment and payment of taxes - community involvement and service - fbi fingerprints with both last names

Yes, I do have a lawyer. We obtained the evidence for almost everything that I mentioned above except a mortgage agreement.

I’m going to do it today. I have an appointment in the afternoon. It’s the last document that we need. My lawyer has scheduled an appointment.

hey guys! I just wanted to share with you that I received my second extension for Prima Facia that was going to expire in March for another 6 months. Are there any updates in your cases?

I got my prima fascia two weeks ago and it’s good for 6 months too . I filed September 2019 so I am expecting to hear from them eaither on March or April .

Did you notice that the processing times for VAWA cases are longer now? 18.5-24 months instead of 17-23 as it used to be.

it keeps changing every month so maybe next month will go back again for 17-23 .

I hope so! my lawyer is waiting for FBI clearance of my fingerprints and will submit RFE response after that.

when you have to establish prima fascia , they send a request to submit something . I got RFE for good moral before they issued a prima fascia to . this is my second RFE .

I submitted all evidence with the case and was issued Prima Facia without RFE. So, it was my first one. And hopefully the last one!

Hi Omar! My lawyer received my RFE letter, it was not delivered to my address, because it’s considered not safe to release in VAWA cases. But if you scroll up - I remember that I copied everything they requested to my message. so you can just take a look at what I had to answer.
