travel while i130 pending
so my father spoke to someone at immigration office in his country..they told him he can't travel since is case is so close for an approval he told them he need to come to my
graduation..anybody have experience with traveling with i130 pending I'm mad now 😒

are you doing AOS or consular processing? if it’s consular processing you might have enough time in between I-130 approval and visa interview to travel (depending on your travel date and pd date) but if you are applying for AOS it might be risky for your dad to leave the country since he would run the risk of missing his biometrics or visa interview.

okay so it sounds like you would have enough time then for him to visit but you would still run into a problem with obtaining a visitor visa from the Jamaican Embassy since no US embassies are issuing visitor/tourist visas unless it’s an emergency. If Jamaica was part of the ESTA visa waiver program then it wouldnt be an issue for your dad to travel to the US since he wouldn’t need to go through the US Embassy to obtain a temporary visitor visa but it doesn’t look like Jamaica is on that list of countries unfortunately:/

I have the same situation with my husband whose in Croatia (also not in the ESTA program ) so that’s why I’m just traveling abroad to visit him.

my i-130 case is approved, I also have a Visitor's Visa. I have recently traveled to the US only in Jan. and had no issues. I'm in the BVI currently.

CBP strongly discourages travel to the United States under tourist status after applying for an immigrant visa. United States law assumes that all foreign travelers are intended immigrants until they can convince the CBP Officer otherwise. Once there is a stated intent to immigrate on record, it becomes difficult to convince the admitting CBP Officer that you are entering for tourism purposes only and will return to your country timely.
Presenting all of the following documents may help verify strong ties to your country and possibly convince the admitting CBP Officer that you are compelled to return there:
• Roundtrip ticket.
• Proof of employment - pay stubs (including a letter from employer stating the date you are expected back to work.)

• Copy of deed, mortgage statement, or lease to property in your home country reflecting your name.
• Most recent utility statements for that property reflecting your name.
