travel basis AP vs visa?
hi, wanted some suggestion. my wife’s I-131 got approved few days back, yet to receive the card/ approval notice. she has a valid visa till Oct 23 and needs to travel outside the US in Apr. her 485 is pending (she’s dependent based on my eb1c filing, I-140 already approved). is it prudent to use her visa instead of i-131 for her travel as I understand that if she uses her AP card, upon return to the US she’ll be tied to her pending gc application as a parolee. welcome thoughts/ suggestions.

unless it’s a non-immigrant visa and assumes a non-immigrant intent when there is a pending 485. consult the lawyer, I would use AP

I would use visa. use AP as a last resort only

Oct 2022. recvd AP approval y’day

consulted my immigration firm and they suggested using valid visa. if using AP, the status will be a parolee tagged to pending gc application.
