ten year green card given by mistake
I saw a post where someone was saying they got a ten year instead of a two and their marriage was less than two years we were saying to keep it
I just found out that it a green card for ten years when the marriage is less than two is a mistake
you have two options
1. file form to send it back or inform them that they made a mistake. I think it’s form I-90 or I-190
2. treat it as a two year green card and at the three months mark that you would apply for your ten year reapply because when you go to get your citizenship the fact that you help on to that green card and didn’t remove the conditions they can and might put you into removal proceedings
I hope the person seems this or if someone could comment back on that post I’ve been trying to find it

you are right Krystal. there is lawyer(Jim hacking), he made a video about it.
krystal usaAug 16, 2021
@naim he is the one I saw
krystal usaAug 16, 2021
@quan sometimes they do make that mistake.
with the person with the interview uscis have the right to waiver a interview so I’m thinking that’s what they did with the person you know of
quan quanQAug 16, 2021
oh i sew well ask your lawyer or call them
krystal usaAug 16, 2021
@quan for what? I have not gotten my green card as yet my interview was scheduled. I just remembered someone had posted about that here so I’m just putting it out there for persons to know what to do so they don’t mess them selves up in the long run
Victory VictoryAug 16, 2021
why do you consider it a mistake?
krystal usaAug 16, 2021
because if the marriage is less than two years you must get a two year conditional green card it’s the law I would say but it’s a must that you get that
Victory VictoryAug 16, 2021
Not in all cases, I know 4 people who got their ten years green cards without getting two years. when they got approved after interview, months later, they got ten years in the mail and two of which have gotten citizenship
krystal usaAug 16, 2021
how long were they married for?
Victory VictoryAug 16, 2021
less than a year. infact, one of them didn't even get ead, but got approved for ten years greed cards months after interview. By the way, who told you guys that you cannot be approved for ten years greed card for a marriage that's below a year? it's not bounding that you receive conditional greed card. The officer can recommend that you get ten years based on what gather during the interview and your information provided.

two years green card is not compulsory for marriages less than 2 years. in some situations, the officer may issue you 10 years if they are convinced beyond all reasonable doubt that the marriage is real. I know a couple who got 10 yrs green card in a 1.6months old marriage. They have a child, they have a house, she was in her second pregnancy. it all depends.

ok well I was just sharing what I heard from a lawyer Jim hacking.
you guys could very well be right also

I agree with the original post. If your marriage is less than 2 years and you get a 10 year green card. That is a mistake!!! You must contact USCIS and let them know. The issue arises when you decide to apply for citizenship. Usually you will have to file an I-751 to remove conditions. Without doing so, you basically do not qualify for citizenship. It is immigration law. Some people have been in this situation and got denied at the citizenship interview.
krystal usaAug 16, 2021
@elvis that’s what I’m saying
elvis aAug 16, 2021
@krystal USA. I completely agree with you! But we can only share the information lol. Hopefully no one here makes that mistake. It will cost a lot of headaches
krystal usaAug 16, 2021
yes, as I said they can deport you just for that so make maybe a call to them to find it if you still need to remove the conditions or just go ahead and do it but it’s best to be on the safe side
Dani AdeAug 16, 2021
you can be approved for a 10 year green card. it’s actually at the discretion of the IO. what matters is you’ve proved beyond doubts that your marriage is bonafide, it’s called green card without conditions. Google it.
elvis aAug 16, 2021
@Dani Ade. that is just wrong.
elvis aAug 16, 2021
Just so everyone knows. This rule is for marriage base cases
quan quanQAug 16, 2021
yes Krystal I agree put it out
santa CruzAug 16, 2021
woooo..
that's a blessing 🙏 to right there...
God works in extraordinary ways 🙏
krystal usaAug 16, 2021
@santa what are you talking about?
santa CruzAug 16, 2021
@krystal... I mean if 2yrs conditional is given to couples under 2yrs if marriage but they were given 10yrs. according to me, that's a blessing from God
krystal usaAug 16, 2021
yes it is but with receiving the ten year the lawyer was saying it’s a mistake why they got that
I’m not saying the office couldn’t have given them that at their discretion
but it’s best to find out if there are any conditions to it
or treat it like a 2 year conditional green card and when the time comes apply for the conditions to be removed because if you don’t when you apply for citizenship you might get deported they won’t be saying oh my mistake I have you a ten year
so I’m just saying it’s best to be on the safe side…. it can be a blessing now but a curse later
santa CruzAug 16, 2021
@krystal u are right...
it's better to be save now than say sorry later
