aren’t you supposed to file I-485 after the approval? I think you are meant to file I-485 with the approval notices and all other evidence for your category.

I think you need to let your field office know that your wavier is approved so that they could open or carry on with your adjustment case

the question is “was an adjustment of status filed?”

if he has to apply for I-212 and I-601 that means he had some legal issues in the USA that prevents him from filing form I-485! reason why he applied for I-212 and I-601 because that’s kinda my situation but i have filed I-212 (approved) and filed I-601A (waiting on a response)

@ Brayan castanon! my i130 was approved but just noticed I was on order removal! I never knew that! do you know what I can do please! I my i130 just got approved yesterday

@ jboy jboy you need a lawyer so that he or she should find out if you have a court date already for your removal and when you have one go to court and show your approved I-130 and either adjust your status infront of the judge or ask the judge to dismiss your removal processing and then you can adjust your status with USCIS

@o j my order of removal was in dec 2019,i was denied in my 1st interview! I now refiled! I didn’t get any notice that I have a judge case then! the case has been established! I don’t know what to do

@jboy jboy if you were order to be deported already you will need a waiver but try to get a lawyer

@ O J I think I was order to be deported! I didn’t get the notice to appear in immigration court so there was judgement in absential! Thank God for the IO who told me and he still approved my recent i130! I am researching for a good lawyer! thanks O J

if you were ordered deported you gonna have to apply for the waiver I-212. my case was similar! i had a Immigration interview but since I moved! i never got the letter to appear at my court, so I was ordered to be deported and i did not know that until i was in the process of the I-130! so I contacted a good lawyer and we applied for the I-212 Application for permission to reapply for admission. now I am waiting for my I-601A Applications for provisional unlawful presence waiver! to get approved

@brayan castanon will you be in the country before you apply for waiver or you have to be outside the country? some people say it’s better to apply to reopen the case instead of applying for waiver! I am still confused!

well in my case i was not able to reopen my case because it was too late to reopen! so that’s why i had to do the I-212. you can apply for the waiver while you inside the country but if you plan on leaving the country it will be best to apply outside

how late was it? was it up to 3years? I want to try to file a motion to terminate! my case decision was 3years

I was 3 months late! I was not allowed to file motion since I missed my court date and I was 3 months late!

no i did not leave the country! i stayed and filed I-212 (approved) in September of 2021 i filed for I-601A (pending) but the I-601A is taking up to 3 years depending on the service center thay receives it! but if you go outside the country you may spend less time, both forms taking like 8 months when you’re abroad

when I apply I-212 so it’s coming receipt ????
