Scheduled interview based on previous i-i30 to VAWA
Hi Guys, I got scheduled for the interview based on an i-i30 for marriage, but the thing is I have already applied for Vawa. I got the Vawa receipt notice and sent a letter to uscis telling them to hold the i-485 in abeyance and convert the i-I30 to the i-360. It being more than 3 weeks now since my lawyer sent that letter but we didn't receive a response about the letter. Would I still need to attend the interview as scheduled the day even I have already sent a letter to the local field office informing them about the Vawa case? my lawyer think it not necessary to go to the interview to show them anything of the Vawa but I called uscis customer service now, and they said if an interview was scheduled it didn't matter whether I sent them a letter or not, I still needed to appear for the interview! What am I supposed to do? To go or not to go to the interview? my lawyer definitely does not want to go for it, should I just go alone to the interview myself on the scheduled date?

I suggest you should go and tell the officer you’re switching to vawa. if you don’t go, they will deny your i485 and i130. showing up and telling them you’re switching to vawa is going to save you a lot of stress from them denying both application. the officer will put your application on hold until he receive your vawa application.

Go to the interview with your lawyer and bring the I-360 receipt with you and a copy of the letter you asked them to hold the I-485 in abeyance.

it’s best you go. Dont take that risk, cause these guys would look for any reason to deny the application.

You need to go to the interview or USCIS will dismiss your case based on the i130 since they haven’t changed the I 130 into a I 360. just go to the interview and explain them, they will hold your place based on your original adjustment of status.

I was in your shoe.. I also went in for the interview, I present the letter my lawyer gave me to them.. It is the best thing to do go inside with the letter.

@Tsar Fizo I didn't need to go for the interview because my lawyer sent letters that we converted to vawa with the receipt. immigration responded by updating the application, putting it on hold and change the 1-485 to 1-485 for Vawa. I also got my prima facie, ead and advanced parole since then. I am just waiting in line right now and praying for the best.

@Bekind. Hi. I have a same situation with you. I didn’t go to the interview either but I don’t get any response from uscis. May I know what kind of notice after they confirm switching your i-485 to vawa?
