Did you send tax for the last 3 years???? have to be the last 3 years and EAD can take 5+ months. doesn’t matter if you have RFE or not.

I sent last 3 years tax return but USCIS also asked RFE as Tax Return TRANSCRIPT. It’s a summary page

@thata only last year, but only submitted form 1040. I wasn’t aware as I sent all this stuff to my lawyer and he didn’t inform me that I’m missing any documents. if you don’t mind me asking, what tax forms should be included with 864?

My husband doesn’t pay taxes He’s a army retired I did different prove support sponsor. I had to send to them 12 months of he’s salary and Veteran ID and dd214, deeds, car insurance etc …. but I think the BABA send to you what you have to do. :)

Hello all, I have a question here please? i got an RFE too regarding the I-864. my question is can I send only the transcript from the IRS. instead of 1040 and W-2 forms???

i actually can’t get the 1040 what’s the best solution?

we have the same timeline. all I submitted was my husband’s entire 1040s and schedule C cos he owns a business too and didn’t receive any RFE . I was scheduled for my biometric the same day as you. to be done on the 22nd but I walked in and had it done on the 12th, an hour later my case status changed to “actively reviewing”. it’s a good thing you sent it back immediately cos RFE sometimes slows down the process.

@ Paige, i submitting only the 1040 and didn’t include W2 the first time. when I sent in the response I just added the W2. I hope you added everything you needed. it’s cool we have the same timeline, I hope we get a quick response. my biometrics is scheduled for august 24. I’m afraid of going earlier so I’m thinking of just waiting. also, what is your country of citizenship if you don’t mind me asking?

@A H I didn’t include W2’s cos my husband is a business owner just bank statements, 1040’s and schedule C. I walked in with my husband cos he’s a veteran (not sure if that’s a criteria) to get my biometric and also it’s just 15mins away from where I live. I’m Liberian.

@Paige your husband is veteran? mine is too!!!! my husband doesn’t have business but he is 100% disability. I have RFE because I sent it just 3 months of his salary and I supposed send 12 months, house deeds, car insurance and his dd214. I responded my RFE 07.10.22 and I’m still waiting for notifications. (I was doing with lawyer 🙄and he didn’t send right).

@ thata hi! yes you should have sent for a whole year and any tax filed. I’m not using any lawyer my husband is good with paperwork he handled everything himself. he added both relevant and irrelevant documents lol cos you know how the US govt likes paperwork (house deed, insurance, auto insurance, life insurance, business insurance, health insurance, bank statements, 1040’s and schedules, social, passport, ID, dd214 ( he said they don’t really need but still included it) since he has a veteran stamped on his ID and also his veteran’s ID, my ID, photos, marriage certificate and medical.

@faiz yes you can send irs transcripts too matter of fact they validate the transcripts faster than the 1040’s. I didn’t use the transcripts because we were already planning a trip out of state prior to my filing date and my husband couldn’t remember his IRS2Go password we had to request a code which takes about 15/30 days.

@paige my husband hasn’t any tax filed he is not taxable but the other stuff that you listed We sent and the dd214 a lawyer told was to include because he’s 100% disability (another lawyer and We read that you have to send too)

@paige K …… not a lot of people know about how to filed if you sponsor is disability was hard ………… Can disability and social security be used to sponsor an immigrant on the I-864, Affidavit of Support Form? Yes, because sponsorship is determined by the expected income of the current year (as opposed to the income on the previous year’s tax return) disability, workman’s compensation and Social Security can all be used to qualify to sponsor an immigrant. Even if the income is not taxable (i.e. disability), you can still show the evidence of the income with multiple pay stubs and checks issued to you that verify how much you earn in disability each month.

@thata it’s good you sent everything to them. let’s be hopeful. I think they trying to get the EB’s out of the way first. I’ve read about a lot of EB’s success stories lately. hopefully it’ll be our turn soon. let’s keep eachother updated!

@AH hi, I wanted to keep you updated as discussed previously. so on the 25 of august I tired expediting my EAD. Today I received this email We received your request to expedite the decision on your application. Your case is currently under review. You will receive a decision or notice of further action shortly. hopefully waiting for good news.

@paige k I did the same thing I expedited my EAD. I heard that if you get a response about the expedite that means your RFE was approved. did you hear anything back?

@AH I’m not sure… it depends on what reply you got in your email. I didn’t have any RFE to begin with.

@AH I haven’t heard anything back yet after the email. some people said that email most times means approval and some people get RFE first then get approved after. still waiting
