please share your views with me
Hello, I need your views for planning purposes . I have an OPT which will expire in December 2026. I have an approved EB2NIW I-40 with PD February 3, 2025. What are my chances of my PD becoming current for AOS before my OPT expires. Should I plan to enroll back into school to maintain my F1 status after my OPT expires? I’m just lost in my thoughts today and would appreciate your views.Thank you.

Personal opinion-Most likely your date will not be current given the historical trends except something extraordinary happens. The FAD and filling date is still in 2023.
Wait till fall of 2026 and if your date isn’t current, then enroll in another school for Spring 2027 resumption. That way you keep your status while you wait.

In addition to @Dee I, I believe you can make an informed decision once the VB is released for October 2025. From experience, you can tell how far dates will go during the FY from the first VB (October) of a given FY, again, except something extraordinary happens.

Over the past few years, EB2 dates have moved forward 6-8 months per year. I think the best case scenario is that the DOF will be in late 2024 by late 2026
Do you an employer that can enter you in next year's H1B lottery? You can also look for an H1B cap-exempt employer while you wait for your PD to be current, although I've heard that the salary tends to be low for those employers

it's very unlikely or even impossible considering the current trend. they are still giving GC to people who applied in summer 2023, and the 2024 backlog is bigger than previous years. also the number of eb2 GC available is decreasing every year since post COVID due to less spillover from family based gc. that's the reasons we might not see improvement in the bulletin.

@Aaron O Thank you. I am not sure how the H1B lottery works but I will read on that and discuss with my employer if I have a chance.

I will suggest you to look into O visas if your employer is willing to do it, that way you don’t have to go to the H1b visa lottery process😉

keeping in view what’s going on with the movements, I don’t see it current before mid 2027! so it would be better idea to have a backup!
